11403ORDINANCE NO. 11,403 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE BLOCK OF WEST SEVENTEENTH STREET BETWEEN STATE STREET AND IZARD STREET IN THE CITY OF LITTLE ROCK, ARKANSAS; ALSO CLOSING AND VACATING AN ALLEY RUNNING NORTH AND SOUTH THROUGH BLOCK 236 OF THE ORIGINAL CITY OF LITTLE ROCK, ARKANSAS, BETWEEN SIXTEENTH STREET AND SEVENTEENTH STREET. WHEREAS, a petition was duly filed by the Housing Authority of the City of Little Rock with the Board of Directors of the City of Little Rock asking the Board of Directors to vacate, abandon and close a portion of West Seventeenth Street between State Street and Izard Street in the City of Little Rock, being more particularly described in said petition and hereinafter, and also an alley running north and south through Block 236 of the Original City of Little Rock, Arkansas, between Sixteenth Street and Seven- teenth Street; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that that portion of the block of West Seventeenth Street between State Street and Izard Street, more particularly described herein- after and that alley running north and south through Block 236 of the Original City of Little Rock, Arkansas, between Sixteenth Street and Seventeenth Street are no longer needed or required for cor- porate purposes or for use by the general public and adjoining owners in that other streets are available and used for these purposes, and has further ascertained that petitioner is the only abutting landowner upon the portion of West Seventeenth Street and the alley to be vacated and that the necessary consent has been coo `3 3 .r dr -2- given, and that the public interest and welfare will not be adversely affected by the abandonment thereof; NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates, and abandons all its rights, together with the rights of the public generally, subject to the easement of the Sewer Department of the City of Little Rock, Arkansas, in center of said West Seventeenth Street which shall remain in full force and effect, in and to that part of West Seventeenth Street described as follows: Beginning at a point which is the NW corner of the intersection of State & 17th Streets (which is also the SE corner of Lot 7, Block 236, Original City); thence, West along the North R -O -W Line of W 17th street to the NE corner of the intersection of Izard and W 17th Street (which is also the SW corner of Lot 6', Block 236, Origina 1 City); thence, South along the East R -O -W Line of Izard Street to the SE intersection of Izard Street and W 17th Street (which is also the NW corner of Lot 1, Block 237, Original City); thence, East along the South R -O -W Line of W 17th Street to a point which is the intersection of this line and a 210 01' 34" curve which runs through the point of beginning, there being a chord distance of 180 feet between this point of intersection and thepoint of beginning and which curve is the North R -O -W Line of the proposed Wright Avenue Bypass; thence Northeasterly along the arc of said 210 01' 34" curve to the point of beginning. And the ownership thereof shall vest in the owners of the abutting properties. Section 2. The City of Little Rock, Arkansas, hereby releases, vacates, and abandons all its rights, together with the rights of the public generally in and to the following described a Iley: -3- A North and South alley lying in the approximate center of Block 236 of the Original City of Little Rock and extending from West Seventeenth Street to West Sixteenth Street. And the ownership thereof shall vest in the owners of the abutting properties. Section 3. The rights now held by the Sewer Department of the City of Little Rock, Arkansas, under an easement which it holds in the center of West Seventeenth Street for the purposes of laying and maintaining a sanitary sewer are hereby expressly excepted from the rights hereinabove released, vacated and abandoned by the City. Section 4. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the Deed Records of said county. Section 5. This Ordinance shall take effect and be in force from and after its passage. Section 6. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
