11501ORDINANCE NO. 119501 AN ORDINANCE AMENDING CERTAIN SECTIONS OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ZOCK, ARKANSAS; REMOVING AMBULANCES FROM STATUS OF EMERGENCY VEHICLES; PROVIDING FOR THE REGISTRATION OF AMBULANCE SERVICE OPERAIORS AND AMBULANCE DRIVERS; AND FOR OTHER PURPOSES. M BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE N ROCK, ARKANSAS: ta SECTION 1. Section 5.1 of the Code of Ordinances of the City of Little Rock, Arkansas, is hereby amended to read as rd follows: 0 A "SEC. 5.1. Definitions. 0. (a) An 'Ambulance' is defined to be any privately -owned vehicle equipped and used for transporting the wounded, injured or sick, but shall not include invalid coaches or 0 funeral coaches. M r-I The foregoing definitiion shall apply to any and all r 0 such vehicles operated in the City of Little Rock, regard- less of whether or not the regular base for operation and dispatch of such vehicles is located outside the City of Little Rock. (b) An 'Ambulance Service Operator' or 'Ambulance Operator' is defined as a person, firm, or corporation which engages in the business of dispatching and operating ambulances. (c) An 'Ambulance Driver' is defined to be a person whose occupation it is to drive an ambulance. (d) 'Board of Directors of the City of Little Rock' is defined to include not only the Board itself, but also any officer or subdivision of the municipal government duly designated by the Board. (e) 'Chief of Police of the City of Little Rock' is defined to include not only that officer, but also any officer or employee of the Police Department duly designated by him." GG O -3.` A -F - 2 - SECTION 2. Section 5.2 of the said Code of Ordinances is hereby amended to read as follows: "SEC. 5.2 Ambulance not emergency vehicle. An ambulance shall not be considered an authorized emergency vehicle entitled to the privileges and exemptions of authorized emergency vehicles under any circumstances." SECTION 3. Section 5.3 of the said Code of Ordinances is hereby amended to read as follows: "SEC. 5.3 Exemption from certain traffic laws. (a) The driver of an ambulance while same is in operation as such may: (1) Park or stand, irrespective of other Ordinances of this City, and may disregard traffic regulations pertaining to usage of lanes, provided, however, that no traffic lane marker shall be disregarded if there shall be vehicles in or so near the immediate area, so as to create any danger or hazard to any person or property by proceeding in disregard of any such traffic lane marker; provided further that at all such times the flashing light described in subsection (2) hereof shall be in use. (2) While moving, parking or standing in connection with its use as an ambulance, display a flashing red light, visible from the top of said ambulance for a distance of five hundred (500) feet under normal atmospheric conditions to the front, sides and rear of said vehicle. (b) No ambulance shall violate any traffic ordinances of this City other than as described in Subsection (a) above, and shall not, while within the limits of this City, use any audible signal by bell, siren or exhaust whistle, or otherwise, with which any such ambulance may be equipped." SECTION 4. Section 5.8 of the said Code of Ordinances is hereby amended to read as follows: "SEC. 5.8. Same- Period of drivers license; renewal. (a) All licenses to ambulance drivers issued in pursuance of the authority of this ordinance, shall extend for a period of one (1) year. Each application for renewal shall be accompanied by an application fee in the same amount as the original application fee called for under this ordinance. -3- (b) Upon applying for renewal of any license issued to any ambulance driver, the applicant shall submit evidence that he has, within the three months preceding his appli- cation, completed a standard course in First Aid as taught by the American Red Cross. It is the intention of this ordinance that every licensed ambulance driver shall com- plete such a course every year while he continues to be licensed as an ambulance driver." SECTION 5. Section 5.10 of the Code of Ordinances is here- by amended to read as follows: "SEC 5.10. Periodic inspection of ambulances; suspension The Chief of Police shall cause to have made periodic inspections of the ambulances of all ambulance service operators licensed hereunder at least every six (6) months. If any ambulance be found mechanically defective, the operator of such ambulance service shall immediately with- draw such ambulance from use until the mechanical defect is corrected and written authority is procured from the Chief of Police or his authorized representative permitting the re -use of such ambulance. No ambulance owned or operated by an ambulance service operator licensed here- under shall be equipped with bell, siren or exhaust whistle. The Chief of Police shall ascertain that no such equipment is present on any ambulance inspected by him, and he shall direct that any ambulance so equipped shall be withdrawn from service until such equipment is removed." SECTION 6. Section 5.13 of the said Code of Ordinances is hereby amended to read as follows: "SEC. 5.13. Charges - Limitations. No ambulance service operator shall be permitted to make any different charge for services rendered because the services were rendered under circumstances constituting an emergency or conditions of similar import." -4- SECTION 7. Sections 5 -14 and 5 -15 of said Code of Ordinance are hereby repealed in their entirety. SECTION S. Because at the present time the operation of ambulances as emergency vehicles constitutes a hazard and a menace to the life and safety of citizens and an impairment to traffic control, and because this situation is hostile to the best interests of the community, an emergency is hereby declared to exist and this ordinance is found to be necessary for the preservation of the public peace, health and safety and shall be in full force and effect from and after its passage.
