3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDS; TO
4 AUTHORIZE THE EXECUTION OF A CONTRACT WITH THE
5 ADMINISTRATIVE OFFICE OF THE COURTS FOR SOFTWARE
6 IMPLEMENTATION SERVICES FOR UTILIZATION OF THE
7 CONTEXTE CENTRALIZED CASE MANAGEMENT SYSTEM, IN AN
8 AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY -FOUR
9 THOUSAND, TWO HUNDRED DOLLARS ($124,200.00); AND FOR
10 OTHER PURPOSES.

12 WHEREAS, on November 19, 1990, the Arkansas Supreme Court issued a Per Curiam Opinion
13 appointing a Committee on Automation to study and make recommendations concerning the incomplete
14 and incompatible technical systems utilized at that time by various courts and justice agencies throughout
15 the State; and,
16 WHEREAS, as a result of the Committee's recommendations, the Arkansas Supreme Court
17 authorized the Administrative Office of the Courts (AOC) to enter a contract with Xerox for a State -wide
18 software license to provide case and jury management to all Arkansas courts; and,
19 WHEREAS, the AOC holds a statewide license for the Contexte application, a web -based case
20 management system that is capable of managing all aspects of court cases, including accounting, judge
21 assignments, violations, hearings and parties, and that serves as the basis for sharing up -to -date case
22 information with the public and with justice agencies such as Driver Services; and,
23 WHEREAS, participation in this statewide case management system is available only through the
24 AOC.
25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
26 OF LITTLE ROCK, ARKANSAS:
27 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a Contexte Case
28 Management System implementation agreement with the Administrative Office of the Courts, in a form
29 to be approved by the City Attorney, in an amount not to exceed One Hundred Twenty -Four Thousand,
30 Two Hundred Dollars ($124,200.00) on behalf of the Little Rock District Court of Pulaski County.
31 Section 2. Because the Arkansas Supreme Court authorized the Administrative Office of the Courts
32 to facilitate a centralized case management system through a contract with Xerox for a State -wide
33 Contexte software license, and because the Little Rock District Court can participate in this case

management system only through a contract with the AOC, the Board declares that it is impractical and
unfeasible to submit this matter to a competitive bid process, and, therefore, waives competitive bidding.
Section 3. Funds for this purchase are available from the District Court Automation Fund.
Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this ordinance, are hereby repealed to the extent of such inconsistency.
