11452ORDINANCE NO. 11,452 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE STREET IN BLOCK 21 PEAY AND WURTHEN ADDITION TU THE CITY OF LITTLE RUCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 10th day of December, 1963, asking the Board of Directors to vacate and abandon all of the street in Block 2, Peay and Worthen Addition to the City of Little Rock, as designated on the plat of said Addition now appear- ing on record in Deed Book 1, Page 125, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public ease- ments in said street. WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street, hereinbefore described, has heretofore been dedicated to the public use as a street, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the street to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be ad- versely affected by the abandonment of such street. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: All that part of the 1100 block on South Fillmore Street, formerly shown as Peay Street in Block 2 of Peay and Worthen Addition to the City of Little Rock, Arkansas. Subject, however, to any public utility and drainage easements located-in said street. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. Page 2 SECTION 3.
