11647t ORDINANCE NO. 11,647 AN ORDINANCE CONDEMNING CERTAIN LANDS LOCATED WITHIN THE CITY OF LITTLE MOCK FOR STREET RIGHT -OF -WAY. TO BE USED.. FOR THE IMPROVEMENT AND CONSTRUCTION OF NORTH BRYANT STREET IN THE CITY OF LITTLE ROCK; DIRECTING THE CITY ATTORNEY TO INSTITUTE PROPER CONDEMNATION.PRO- CEEDINGS TO CARRY OUT THE INTENT AND PURPOSES HEREOF; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock does hereby con- demn for Street Right -Of -Way and drainage facilities, the following described parcel of real property situated in the City of Little Rock, Arkansas: A part of the W�2 of the SWk of the NEk of the NW4 of Section 36, Township 2 North, Range 13 West, more particularly described as commencing at the SE corner of the said Wk of the SWk, NEB, NWT, then North 133.5 feet to the point -of beginning of said tract, thence North 66.75 feet, thence West 25 feet, thence South 66.75 feet to a point, thence East to the point of beginning, containing 1,668.75 square feet more or less, which pro- perty appears to be owned by the heirs of Lewis Douglass, Deceased, consisting of Margaret Douglass, Widow; Charlie Douglass, W. A. Douglass, Henrietta Douglass Kelley, and Lewis Douglass, Jr. and Robert Douglass, together with persons known or unknown who may be the heirs of Lewis Douglass, Deceased. The aforesaid lands are necessary to be utilized in the construction and improving of NorthBryant Street in the City of Little Rock and to provide for necessary storm drainage and related facilities. � y - 2 - SECTION 2. The City Attorney is hereby authorized and directed to file in the proper court proceedings for the condemnation of the properties described in Section 1 hereof and to secure an order of such court allowing the City to take immediate possession of the properties described upon its posting bond in an amount to be deter- mined by the court and to do any and all other things reasonably necessary in obtaining immediate possession of said lands. SECTION 3. Whereas, the condition of thoroughfares and required traffic facilities within the City of Little Rock for vehicular traffic and fire protection are inade- quate in and around the area between Evergreen Street and Cantrell Road and between University Avenue and Mississippi Avenue, thereby causing congestion, lack of access, and other problems of vehicular movement North and South through the afore - described area, and, whereas the proposed improve- ment and development of North Bryant Street is designed to relieve the aforesaid congestion and lack of access for fire protection and for other purposes, thereby enhancing the welfare, health and safety of the citizens of this City, an emergency is hereby found to exist and this Ordin- ance, being necessary in the implementation and construction of adequate facilities for North -South vehicular traffic in the affected area, shall upon its passage and approval be- come immediately effective.
