There is hereby appropriated the sum of lvinety Thousand and No /100 Dollars ($90,000.00) from unappropriated balance in Street Right -of -Way Fund to Street Right -of -Way Fund, Project I (East -West Expressway) for the acquisition of right -of- way on lands held under lease and utilized by the United States of America, Department of Navy. SECTION 2. The release of said funds from Street Right -of -Way Fund - Project I, to the United States of America by warrant issued to the Treasurer of the United States shall be subject to compliance by all parties with the conditions and provisions of certain letter addressed to Mr. Ancil M. Douthit, City Manager, and signed by A. M. Pollard, Commander, CED, USN, which letter is in form and substance as follows: Fm! -2- SECTION 3. City Manager Little Rock, Dear Sir; GULF DIVISION BUREAU OF YARDS AND DOCKS HEADQUARTERS SUPPORT ACTIVITY NEW ORLEANS, LA. 70140 IN REPLY REFER TO 61 /ACW /ve Douthit Arkansas 72201 U JUL 1965 Reference is made to the proposed relocation of the south wing of building No. 1, buildings No. 2, No. 3, No. 5 and Noo 11, located at the Naval and Marine Corps Reserve Training Center, Little Rock, Arkansas, and the modification of Lease Noy(R) -44097 at War Memorial Park to further the construction of the East West Expressway. It is understood that legislation has been introduced in Congress to add $90,000.00 to the Navy and Marine Reserve Forces funds to accom- plish the moving of the above buildings. The authorizing legislation will provide for the modification of the lease to delete therefrom the land needed for the highway right -of -way. During a meeting in the Office of the Chief of Staff, Eighth Naval District, on 27 July 1965, you stressed the necessity that the Navy proceed and move its buildings and modify the lease in order that the awarding of construction contracts for the Expressway would not be delayed. The Navy will, of course, do everything it can to expedite the removal of the buildings. However, as you were advised, the Navy can enter into a contract only after the funds for that contract have been appropriated. Your suggestion that the City of Little Rock advance the $90,000.00 to the Navy for the relocation of the above mentioned buildings, with the understanding that these funds would be reimbursed to the City if and when Federal appropriations therefor become available, has been thoroughly considered. It has been determined that upon receipt of a check for $90,000.00, made to the Treasurer of the United States, from the City of Little Rock, the Director, Gulf Division, Bureau of Yards and Docks will proceed without delay to enter into contracts for the relocation of the buildings at the Naval and Marine Corps Reserve Training Center from the proposed East-West Expressway right -of -way. A Bight of Entry r, 61 /ACW /ve to the City of Little Rock And its assigns to enter upon the proposed right -of -way in order to commence preliminary work on the Expressway will be provided. When and if the Federal appropriation of $90,000.00 for the moving of the buildings is made available to the Navy, the $90,000.00 will be reimbursed to the City of Little Rock and Lease NOy(R)-44097 will be modified to delete therefrom the land required for the East -West Expressway. As Federal money will be involved in both the moving of the buildings and the construction of the Expressway, it behooves all concerned to accomplish this construction in-the most economical manner. Paragraph 8 of Lease NOy(R) -44097 provides that the Government, if required by the Lessor, shall, before the expiration of this lease, restore the premises to the same condition as that existing at the time of entering upon the same under this lease, provided the Lessor requires such restoration. The Lessor must give written notice thereof to the Government twenty days before the termination of the lease. The Navy will remove its buildings from the right -of -way, but it is believed that your highway contractors, with their heavy equipment, will be able to remove the floor slabs and foundations of the buildings much cheaper than can the Navy's contractors. With this in mind, it is re- quested that the City of Little Rock agree to waive its right of restoration of the premises as to the Expressway right -of -way.
