AN ORDINANCE APPROVING AND ACCEPTING THE
ANNEXATION TO THE CITY OF LITTLE ROCK, ARKANSAS,
OF CERTAIN LANDS LOCATED IN THE SE-14, NE4 AND
SW4 , NE -L4 AND SE-14, NW-4., SEC. 4 , TWN . 1 N, R. 13
W. IN PULASKI COUNTY, ARKANSAS, SAID LANDS BEING
PART OF BIRCHWOOD ADDITION PLAT NO. 2, CUNNINGHAM'S
REPLAT OF WEST HIGHLAND SUBDIVISION, AND THE SOUTH
141.9 FEET OF TRACT 27
WHEREAS, the County Court of Pulaski County, Arkansas,
entered its Order on May 18, 1965, upon the Petition of Bob James,
et al. and J. Drew Avance, their attorney, said Petition representing
more than six (6) qualified voters having a freehold interest, having
signed the Petition, after due notice of hearing on said Petition for
the time and in the manner prescribed by Law, ordering the annexation
of the following described lands located in Pulaski County, Arkansas:
Part of Birchwood Addition, Plat No. 2, Lots 39
through 137, Lots 141 through 147, located in the
SV4, NE-14 and SW4, NE4 and SE4, NW4, Sec. 4, TWN 1
N, R 13 W, as recorded in Plat Book 8, Page 56,
Deed Records Bk. 734, Page 70, June 16, 1960, and
Cunningham's Replat of West Highlands Subdivision,
containing Lots 1 through 13 and unimproved Lots 14,
15 and 16, being the south 141.9 feet of Tract 27,
and a strip 141.9 by 307 feet South of Cunningham's
Replat and North of Hermitage Rd., Sec. 4, Twn. 1 N,
R. 13 W, as recorded in Plat Book 1, Page 273 on
April 13, 1916, to the City of Little Rock.
WHEREAS, more than thirty (30) days have elapsed since the
entry of said Order of the County Court of Pulaski County, Arkansas,
and no person, firm or corporation, has instituted any proceeding in
the Circuit Court of Pulaski County, Arkansas, or elsewhere, to
prevent such annexation, and no protestants have appeared and no
notice given to the authorities of the City of Little Rock, Arkansas,
of any attempt to vacate, review, set aside or appeal from said
Order of the County Court; and
WHEREAS, said above described lands are contiguous to and
adjoin the City of Little Rock, Arkansas;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. That the City of Little Rock, Arkansas,
acting through this Board of Directors,
does hereby approve the annexation of,

and does hereby accept and make a
part of the incorporated area of the
City of Little Rock, Arkansas, all of
the lands described hereinabove in this
Ordinance; and that said lands be and
are hereby assigned and attached to the
5th Ward of said City.
Section 2. IT IS FURTHER ORDERED that when two
copies of the entire proceedings of the
Pulaski County Court concerning this
annexation have been prepared and duly
certified by the Pulaski County Clerk,
one copy of said proceedings shall be
delivered to and filed with the Secretary
of State of the State of Arkansas,
Pursuant to Arkansas Statutes (1947),
Section 19 -305.
