11610Ic ORDINANCE N0. 111610 AN ORDINANCE GRANTING A FRANCHISE TO THE STATE OF ARKANSAS IN CERTAIN PUBLIC RIGHT -OF -WAY ADJACENT TO THE CAPITOL GROUNDS IN THE CITY OF LITTLE ROCK FOR THE PURPOSE OF INSTALLING A SPRINKLER SYSTEM; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. A right, privilege and franchise is hereby granted unto the State of Arkansas in and to certain public property and right -of -way, more particularly described in Sec- tion 2 hereof, which right, privilege and franchise extends for the sole and exclusive purpose of installing within said right -of -way and public land a sprinkler system for use in the maintaining of adjoining yard and landscape improvements on the Capitol Grounds in the City of Little Rock, Arkansas. SECTION 2. The right -of -way and public property in and to which the above right, privilege and franchise is granted is described as follows: "Beginning at the Southwest corner of Block 150 Faust Addition to the City of Little Rock, Arkansas; thence North along the right -of -way line of Battery Street a distance of three hundred twelve (312) feet to a point; thence West seventeen (17) feet to a point; thence South parallel to the East right -of -way line of Battery Street a distance of three hundred twelve (312) feet to a point; thence East seventeen (17) feet to the point of beginning, excepting and excluding therefrom that portion of the above - described right -of -way which is occupied by an existing sidewalk; and Beginning at the Southeast corner of Block 150 Faust Addition to the City of Little Rock Arkansas; thence North one hundred twenty -seven (1275 feet along the West right -of -way line of Wolfa Street; thence eleven (11) feet East to a point; thence South one hundred twenty -seven (127) feet to a point; thence West eleven (11) feet to the point of beginning, excepting and excluding therefrom that portion of the said right -of -way which is covered and occupied by an existing sidewalk therein." SECTION 3. The right, privilege and franchise granted herein shall at all times be subject to the need of said property for other public uses and, upon demand by the City of Little Rock, the State of Arkansas will, at its sole expense, restore 04C G -4 -2- said right -of -way to its condition prior to granting of this franchise and privilege and shall save and hold harmless the City of Little Rock from any and all expense or liability in connection therewith.
