AN ORDINANCE VACATING NORTH TYLER STREET
IN THE CITY OF LITTLE ROCK, ARKANSAS,
BETWEEN "H" AND "I" STREETS
WHEREAS, the Most Reverend Albert L. Fletcher, as Bishop
of the Catholic Diocese of Little Rock, filed a petition with the
Board of Directors of the City of Little Rock, asking the Board
to vacate and abandon all that portion of North Tyler Street
lying between "H" and "I" Streets in said City; and
WHEREAS, said streets were platted initially as Kavanaugh
Street, Arthur Avenue and Harrison Avenue, respectively, but the
names thereof have been changed by appropriate action of the
City; and
WHEREAS, after due notice as required by law, the Board of
Directors has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that the petitioner is the owner of all property
abutting the portion of the street to be closed; that the petitioner
is an educational institution operating Holy Souls Elementary
School on both sides of the portion of the street to be closed;
that the existence of said street is a hazard to the children
entrolled at Holy Souls Elementary School; that the petitioner
has filed his written consent to the vacation of the street; that
the portion of the street to be closed is not required for public
purposes; and that the public interest and welfare will be
benefited by abandonment of such street; Now, Therefore,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
Section 1. The City of Little Rock, Arkansas, hereby

releases, vacates and abandons all its right, together with
the rights of the public generally, in and to the portion of
North Tyler Street lying between the South right of way line of
"I" Street and the North right of way line of "H" Street, as
shown by the plat of Hollenberg's Addition to the City of Little
Rock, which plat is of record in the office of the Recorder for
Pulaski County, Arkansas, in Deed Book 76 at Page 450. Provided,
however, the rights of the City of Little Rock and the rights
of privately owned utility companies to maintain any existing
water, sewer, gas, telephone or power line in the portion of
the street to be closed shall continue to exist and shall not be
abolished or affected by this ordinance.
Section 2. A copy of this ordinance, duly certified by the
City Clerk, shall be filed in the office of the Recorder and
recorded in the deed records of Pulaski County, Arkansas.
Section 3. Whereas, the continued existence of North Tyler
Street between "H" and "I" Streets in the City of Little Rock is
a continuing hazard to 650 elementary school children enrolled
at Holy Souls Elementary School, an emergency is hereby declared
to exist and this ordinance shall take effect and be in force
from and after its passage.
