AN ORDINANCE VACATING THE CEMETERY OR BURIAL GROUNDS
SITUATED IN PART OF THE SOUTHEAST QUARTER OF THE
NORTHEAST QUARTER OF SECTION It TOWNSHIP 1 NORTH,
RANGE 13 WEST, IN PULASKI COUNTY, ARKANSAS, MORE
PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT
THE SOUTHEAST CORNER OF SAID SE4 NEB; THENCE NORTH
Oo 071 EAST 25 FEET TO A POINT; THENCE NORTH 880 301
WEST ALONG THE NORTH RIGHT OF WAY LINE OF WEST CAPITOL
AVENUE 620.8 FEET TO THE POINT OF BEGINNING; SHENCE
NORTH 00 271 WEST 125.0 FEET; THENCE NORTH 88 301
WEST 212.0 FEET- THENCE SOUTH Oo 271 EAST 125.0 FEET;
THENCE SOUTH 886 301 EAST ALONG THE NORTH RIGHT OF
WAY LINE OF WEST CAPITOL AVENUE 212.0 FEET TO THE
POINT OF BEGINNING, IN THE CITY OF LITTLE ROCK,
PULASKI COUNTY, ARKANSAS, AND DECLARING THAT IT IS
NOT ANY LONGER A CEMETERY EXCLUSIVELY USED AS SUCH,
AND HEREAFTER THE SAME SHALL BE SUBJECT TO TAXATION
LIKE OTHER PROPERTY.
WHEREAS, Ordinance No. 11,509 was duly enacted and pub-
lished in the mode and manner prescribed by law, wherein the burial
grounds situated in Part of the Southeast Quarter of the Northeast
Quarter of Section 11 Township 1 North, Range 13 West, in Pulaski
County, Arkansas, more particularly described as follows: Commencing
at the Southeast Corner of said SE4 NEh; thence North 00 071 East
25 feet to a point; thence North 880 301 West along the North right
of way line of West Capitol Avenue 620.8 feet to the point of begin-
ping; thence North 00 271 West 125.0 feet; thence North 880 301
West 212.0 feet; thence South Oo 271 East 125.0 feet; thence South
880 301 East along the North right of way line of West Capitol
Avenue 212.0 feet to the point of beginning, in the City of Little
Rock, Pulaski County, Arkansas, were declared old and abandoned
under the authority of Acts of Arkansas 1901, No. 102; persons
having dead buried in said burial grounds were required by
Ordinance No. 11,509 to cause the same to be removed and buried
beyond the limits of the City of Little Rock, Arkansas, within a
reasonable time prescribed in the said Ordinance No. 11,509; and

WHEREAS, the reasonable time for those having dead buried
in said burial grounds to remove same expired February 3, 1965;
thereafter the City of Little Rock, Arkansas, itself did have the
remains of all such persons as could then be found removed and
buried beyond the limits of said city by lawful owners of the
real property where the burial grounds were situated at the
expense of the said lawful owners, all as provided, kuthorized
and directed by Section 5 of Ordinance No. 11,509; presently there
are no bodies or remains of any dead, that could be found, interred
upon the said burial grounds.
WHEREAS, it is in the public interest to have the said
burial grounds lawfully vacated and declared that it is not any
longer a cemetery exclusively used as such, and hereafter become
subject to taxation like other property.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That the City of Little Rock, Arkansas, here-
by declares the burial grounds located within its limits situated
in and upon the following described real property in Pulaski County,
Arkansas, to -wit:
Part of the Southeast Quarter of the Northeast
Quarter of Section 1, Township 1 North, Range 13
West, in Pulaski County, Arkansas, more particu-
larly described as follows: Commencing at the
Southeast Corner of said SE.- NE4; thence North
00 071 East 25 feet to a point; thence North 880
301 West along the North right of way line of West
Capitol Avenue 620.8 feet to the point of begin-
ning; thence North 00 271 West 125.0 feet; thence
North 88 301 West 212.0 feet; thence South 00 271
East 125.0 feet; thence South 880 301t-East along
the North right of way line of West Capitol
Avenue 212.0 feet to -:the point of beginning, in
the City of Little Rock, Pulaski County, Arkansas;
to be, and the same is hereby vacated and declared that it is not
any longer a cemetery exclusively used as such and Hereafter shall
be subject to taxation like other property.

SECTION 2. That the provisions of this ordinance are
hereby declared to be separable, and if any section, part thereof,
phrase or provisions shall be declared invalid, such invalidity
shall not affect the validity of the remainder of this ordinance.
SECTION 3. That all ordinances and resolutions and
parts thereof in conflict herewith are hereby repealed to the
extent of such conflict.
SECTION 4. The Board of Directors has determined that
parts of the real property vacated as a burial ground by this
ordinance are committed to proposed development and improvement
by the owners thereof in the immediate future, and that the said
proposed development and improvements are such as are urgently
needed in the community; THEREFORE, an emergency is hereby declared
to exist and this ordinance being necessary for the immediate
preservation of public peace, health and safety, shall be in full
force and effect from and after its passage and approval.
