11563ORDINANCE NO. 11,563 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING A PORTION OF WEST 28TR STREET, A STREET, SAID PORTION LYING AND BEING LOCATED GENERALLY BETWEEN LOTS 1, 2, and 3, BLOCK 1, RIFFEL AND HOLDER'S ADDITION AND LOT 7, BLOCK 4, OAK GROVE SQUARE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS, AND AN ALLEY RUNNING IN A NORTH -SOUTH DIRECTION THROUGH BLOCK 4, OAK GROVE SQUARE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS, WHEREAS, a Petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 12th day of October, 1964, asking the Board of Directors to vacate and abandon an alley in Block 4, Oak Grove Square Addition to the City of Little Rock and a portion of West 28th Street lying generally between Lot 7 of said Block 4, and Lots 1, 2 and 3 Block 1, Riffel and Holder's Addition, all as shown on plat of record in Plat Book 2, Page 139, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to utility easements in that portion of alley mentioned and described below; WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley and the portion of street hereinafter described has heretofore been dedicated to the public use; have not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley and the portion of street to be vacated have signed either the Petition filed with the Board of Directors or a written consent evidencing their consent to such abandonment; and that the public GC;c-4�- interest and welfare will not be adversely affected but will be best served by such abandonment for all purposes except use by public utilities of that portion of alley hereinafter described. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the alley and portion of street described as follows: ALLEY DESCRIPTION Begin at the Southeast corner of Lot 7, Block 4, OAK GROVE SQUARE ADDITION to the City of Little Rock, Arkansas, run thence North along the East line of Lots 7, 8, 9, 10, 11, and 12 of said Block 4, a distance of 291.5 feet to the Northeast corner of said Lot 12, thence South 89 degrees 23 minutes East, a distance of 20 feet to the Northwest corner of Lot 1, of said Block 4, thence South along the West lines of Lots 1, 2, 3, 4, 5 and 6 in said Block 4, a distance of 291.8 feet to the Southwest corner of said Lot 6, thence North 89 degrees 17 minutes West, a distance of 20 feet to the point of beginning, subject, however, to a 20 foot wide utility easement in the North 100 feet of the alleyway herein vacated and abandoned, said easement in said North 100 feet to be unaffected hereby. DESCRIPTION OF PORTION OF STREET TO BE VACATED Commence at the Southwest corner of Lot 6, Block 4, OAK GROVE SQUARE ADDITION to the City of Little Rock, Arkansas, thence run North 89 degrees 17 minutes West, a distance of 7.65 feet to the point of beginning of this description; from said point of beginning so established, run North 89 degrees 17 minutes West, a distance of 153.35 feet to the Southwest corner of Lot 7, Block 4, OAK GROVE SQUARE ADDITION, thence run in a southerly direction a distance of 20 feet, more or less, to the Northwest corner of Lot 3, Block 1, RIFFEL AND HOLDERS ADDITION to the City of Little Rock, Arkansas, run thence South 89 degrees 17 minutes East a distance of 156.1 feet to a point, run thence North O1 degrees 49 minutes West, a distance of 20 feet, to -2- J ' the point of beginning. (All as shown by plat of record in Plat Book 2 at page 139 in the office of the Recorder of Pulaski County, Arkansas). SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
