AN ORDINANCE APPROPRIATING $316,484.86
FROM THE 1965 CAPITAL IMPROVEMENT BOND
FUNDS TO ACCOUNT 65 S 60 (CHESTER STREET)
FOR EXPENSES OF WIDENING CHESTER STREET
IN THE CITY OF LITTLE ROCK; ACCEPTING THE
BID OF P.B. PRICE CONSTRUCTION COMPANY IN
SAID SUM FOR THE CONSTRUCTION OF SAID
IMPROVEMENTS; AUTHORIZING THE EXECUTION
OF A CONTRACT FOR SAID IMPROVEMENTS; AND
FOR OTHER PURPOSES.
WHEREAS, invitation for bids for the construction
of certain improvements necessary to widen Chester Street in the
City of Little Rock, Arkansas, was duly advertised and bids
received pursuant thereto according to law; and
WHEREAS, the lowest responsible and responsive bid
received was the bid of P.B. Price Construction Company in the
sum of $316,484.86; and
WHEREAS, it is the desire of the Board of Directors
of the City of Little Rock, Arkansas, to accept the said bid and
to authorize the execution of a contract for the prosecution of
the work by the said bidder; and
WHEREAS, in order to fund the execution of said
contract it is necessaky to appropriate funds to be paid during
the prosecution of the work;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. There is hereby appropriated from the
1965 Capital Improvement Bond Funds the sum of $316,484.86 to
account 65 S 60 (Chester Street) to be expended for the widening
of Chester Street in the City of Little Rock, .Arkansas
SECTION 2. The bid of P.B. Price Construction Com-
pany in the sum of $316,484.86 for the work described as widening
of CMeate►i Street as more articularl forth p y set in the bidding
specifications prepared by Garver & Garver, Inc. is hereby accepted.
The Mayor and City Clerk are hereby authorized and directed to
execute for and in behalf of the City of Little Rock, Arkansas a
contract for the prosecution of said work, which contract shall be
in form and substance as follows:

WITNESSETE, that the Contractor and the Owner for the,considerations
stated herein mutually agree as follows:
ARTICLE 1. Statement of Work. The Contractor shall furnish all super-
vision, technical personnel, labor, materials, machinery, tools, equipment,
Incidentals,, and services, including utility and transportation services, and
perform and complete all work required for the Chester Street Widening in
Little Rock, Arkansas, in strict accordance with the Contract Documents, in-
cluding all Addenda thereto, numbered

for the several respective items of work completed, subject to dditions and
deductions as provided in paragraph GC -07, `Changes in the Work', of GENERAL
CONDITIONS.
ARTICLE 3. Contract Time, The Contractor agrees to begin work within ten
(10) calendar days after issuance by the Owner of a "Work Order" or "Notice to
Proceed" and to complete the work within 270 calendar days thereafter. If the
Contractor shall fail to complete the work within the time specified, he and
his Surety shall be liable for payment to the Owner, as liquidated damages
ascertained and agreed, and not in the nature of a penalty, the amount speci-
fied in GENERAL CONDITIONS of these contract do4.amenfor each i of delay.
To the extent sufficient in amount, liquidated damages shall`be Mucted from
the final payment to be made under this contract.
