AN ORDINANCE AUTHORIZING AND DIRECTING THE
PURCHASE OF CERTAIN MARKING COMPOUND FROM
PRISMO SAFETY CORPORATION; AUTHORIZING
PAYMENT; AND FOR OTHER PURPOSES.
WHEREAS, the City of Little Rock, Arkansas, has
recently purchased a "Hite- Liner" painting machine at a cost
of $30,000.00 from the Prismo Safety Corporation, which machine
is especially designed to apply quick drying traffic marking
compounds, a material which is greatly desirable over other
available marking compounds which require longer drying per-
iods; and
WHEREAS, the said Prismo Safety Corporation manu-
factures a special quick -dry traffic marking compound,
especially prepared for use in the machine owned and used by
the City of Little Rock and designed specifically so as to
perform satisfactorily therein without damage or injury to
said machine; and
WHEREAS, it is found that the traffic marking com-
pound manufactured by Prismo Safety Corporation has worked
satisfactorily in the machine;_ owned by this City, and that
this City has an experience with said compound and finds that
same is satisfactory for further use; and
WHEREAS, no other manufacturer has furnished satis-
factory proof to this Board of Directors that a compound, other
than that manufactured by Prismo Safety Corporation, is available
which will work satisfactorily in the equipment owned by this
City and which will perform satisfactorily under traffic

conditions for reasonable periods of time, it being found that
the only other known compound available, when tested under the
direction of this Board of Directors, would not eject satisfac-
torily from the machine, possessed such a high viscosity after
storage that the machine was inoperable for four hours, and
when applied to the streets said compound was friable, chalky
and did not consistently display the degree of strength and
cohesion required to withstand traffic; and
WHEREAS, in the absence of any other known available
product possessing the desired characteristics, though diligent
search has been made therefor and open invitation has been
extended to all persons to have their materials tested and
examined in the hope of finding acceptable and comparable com-
pounds and developing a competitive market between like and
acceptable products, it is found that an exceptional situation
and condition exists and that the required marking compound
should be purchased from Prismo Safety Corporation at this
time; and
WHEREAS, this Board of Directors has reason to believe
that the quantities of traffic marking compound desired and
needed can be purchased by the City of Little Rock from Prismo
Safety Corporation.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. An exceptional situation being found to
exist, the requirement of competitive bidding for the purchase
of traffic marking compound for use in the Nite -Liner machine
owned by the City of Little Rock, Arkansas, is hereby waived.

SECTION 2. The City Manager is hereby authorized
and directed to purchase from Prismo Safety Corporation not
more than 1700 gallons of white and 300 gallons of yellow
traffic marking compound for a total consideration of not to
exceed Thirteen Thousand One Hundred Twenty -Two and 20/100
Dollars ($13,122.20).
SECTION 3. It is found that existing supplies of
traffic marking compound have been depleted, that in order to
mark centerlines, lanes and crosswalks in the City of Little
Rock, it is necessary to procure marking compound for use in
specialized spraying equipment and that there is only one known
source for same, and that further delay in marking the traffic
lanes, centerlines and crosswalks will result in loss of traffic
control to the damage, injury and detriment of the public;
now, therefore, an emergency is hereby declared to exist and,
this ordinance being necessary to alleviate this condition and
for the benefit of the public health, safety and welfare, the
same shall be in full force and effect from and after its passage
and approval.
