AN ORDINANCE ACCEPTING THE BID OF AND
AUTHORIZING A CONTRACT WITH SOUTHEAST
CONSTRUCTION COMPANY IN THE AMOUNT OF
$827,831.86 FOR THE WIDENING, PAVING
AND IMPROVING OF 65TH STREET - PHASE III
IN THE CITY OF LITTLE ROCK, ARKANSAS;
APPROPRIATING THE SUM OF $827,831.86 FROM
THE 1965 IMPROVEMENT CONSTRUCTION FUND TO
PROJECT 65 -S -58 (65TH STREET - PHASE III);
AND FOR OTHER PURPOSES.
WHEREAS, invitation to bid was published for the
widening, paving and re- construction of 65th Street in the
City of Little Rock and bids were received pursuant thereto
according to law; and
WHEREAS, the lowest responsible and responsive bid
was that of Southeast Construction Company in the amount of
Eight Hundred Twenty Seven Thousand Eight Hundred Thirty One
and 86/100 Dollars ($827,831.86); and
WHEREAS, it is the desire of the Board of Directors
to accept the bid of Southeast Construction Company and authorize
the execution of a contract for said construction.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The bid of Southeast Construction Company
in the amount of Eight Hundred Twenty Seven Thousand Eight Hundred
Thirty One and 86/100 Dollars ($827,831.86) for the re- construct-
ion, paving and opening of 65th Street - Phase III in the City of
Little Rock is hereby accepted and the Mayor and City Clerk are
hereby authorized and directed to execute a contract for and on
behalf of the City of Little Rock with said Southeast Construction
Company for the performance of the work in full compliance with
plans, specifications and bid proposal on file in the office of
the Purchasing Agent which contract shall be in form and substance
as follows:

hereinafter called the "Contractor ", and City of Little Rock, Arkansas, here-
inafter called the 'Owner ".
WITNESSETH, that the Contractor and the Owner for the considerations
stated herein mutually agree as follows:
ARTICLE 1. Statement of Work. The Contractor shall furnish all super-
vision, technical personnel, labor, materials, machinery, tools, equipment,
incidentals, and services, including utility and transportation services, and
perform and complete all work required for the 65th Street Reconstruction,
Phase , in Little Rock, Arkansas, in strict accordance with the Contract
Documents, including all Addenda thereto, numbered
dated and
dated , as prepared by the Engineer.
ARTICLE 2. The Contract Price. The Owner will pay the Contractor, be-
cause of his performance of the Contract, for the total quantities of work
performed at the lump sum prices and unit prices stipulated in the Proposal
for the several respective items of work completed, subject to additions and
deductions as provided in paragraph GC -07, 'Changes in the Work , of GENERAL
CONDITIONS.
ARTICLE 3. Contract Time, The Contractor agrees to begin work within
ten 10 calendar days after issuance by the Owner of a "Work Order" or "Notice
to Proceed" and to complete the work within calendar days thereafter.
(Contract time to be filled in after receiving bids based on time limits set
out in the Proposal). If the Contractor shall fail to complete the work within
the time specified, he and his Surety shall be liable for payment to the Owner,
as liquidated damages ascertained and agreed, and not in the nature of a pen-
alty, the amount specified in GENERAL CONDITIONS of these contract documents
for each day of delay. To the extent sufficient in amount, liquidated damages
shall be deducted from the final payment to be made under this contract.
ARTICLE 4. Contract. The executed contract documents shall consist of
the following:

This Agreement, together with other documents enumerated in this ARTICLE 4,
which said other documents are as fully a part of the Contract as if hereto
attached or herein repeated, forms the Contract between the parties hereto.
In the event that any provision in &W one part of this Contract conf;

a surety company of financial resources satisfactory to the Owner and author-
ised to do business in the State of Arkansas.
IN WITNESS WHEREOF* the parties hereto have caused this AGREDENT to be

SECTION 2. The City Manager and Director of Finance
are hereby authorized and directed to pay the contract price
herein provided for in keeping with the terms and provisions
of said contract as and when said work is prosecuted in accord-
ance with plans, specifications and bid proposal.
SECTION 3. There is hereby appropriated from the
1965 Improvement Construction Fund to Project 65 -S -58 - Phase III
(65th Street) the sum of Eight Hundred Twenty Seven Thousand
Eight Hundred Thirty One and 86 /100 Dollars ($827,831.86) to be
used for paying the contract price herein provided for.
SECTION 4. This Ordinance shall be in full force and
effect from and after its passage.
