119441 I ORDINANCE NO. 119944 AN ORDINANCE VACATING THE FOLLOWING STREET AND ALLEYS IN HOLLENBERG'S ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS: "I" STREET BETWEEN NORTH HARRISON AND NORTH TYLER STREETS, THE SOUTH 130 FEET OF THE ALLEY IN BLOCK 9 AND THE NORTH 200 FEET OF THE ALLEY IN BLOCK 16. A petition was filed with the Board of Directors of the City of Little Rock, Arkansas, requesting the vacation and abandonment of the street and alleys hereinafter described. The Board of Directors finds: a. That the following named persons signed the petition and that all of the petitioners are owners of real property in the City of Little Rock: The Most Reverend Albert L. Fletcher, as Bishop of the Catholic Diocese of Little Rock, Lloyd R. Pearce, Mrs. Kathryn Brewer, James H. Larrison, Henry W. Miller, Jr., Harry W. Elliott, Chas. R. Peaker, Leo E. Olberts, Jr., A. W. Johnson and Russell L. King. b. That the petitioner, Albert L. Fletcher, as Bishop of the Catholic Diocese of Little Rock, owns all of the real property abutting the street to be closed, that he owns all of the real property abutting the portions of the alleys to be closed and that he owns the majority of all property in the blocks where those alleys are situated. c. That all of the property described herein is located in Hollenberg's Addition to the City of Little Rock, that a certified copy of the plat of the addition was filed with the petition and that the plat is of record in the office of the Circuit Clerk for Pulaski County, Arkansas, in Deed Book 76 at Page 450. d. That, on the plat of Hollenberg's Addition, the street '-G _ r? C - Sr' originally designated as Harrison Avenue is now known as "I" Street; the street originally designated as Miller Street is now known as North Harrison Street and the street originally designated as Kavanaugh Street is now known as North Tyler Street. e. There are sufficient other East /West streets in the vicinity of the street to be closed to carry the traffic volume of the neighborhood. Also, it is preferred in modern municipal planning to eliminate alleys in residential neighborhoods and to have streets at intervals of 500 to 600 feet instead of 200 to 300 feet apart. Therefore, the portion of "I" Street to be closed and the portion of the alleys to be closed are not required for corporate purposes of the City of Little Rock. f. All property abutting the portions of the street and alleys to be closed is owned by Albert L. Fletcher, as Bishop of Little Rock, as a corporation sole. As such corporation, the petitioner operates Holy Souls Elementary School, an educational institution with more than 650 regular daily students, and Holy Souls Catholic Church. Both of these institutions are located South of "I" Street at the location in question on Blocks 15 and 16, Hollenberg's Addition. Those institutions make a joint use of their existing facilities. The petitioner Fletcher proposes to expand the facilities to the North side of "I" Street and needs to use the space in the street and alleys to be closed for the construction of the new facilities. g. By his written petition, the petitioner Fletcher has consented to the vacation of the street and alleys in question. The Board of Directors finds that the public interest and welfare of the City will be benefited by granting the petition; Now, - 2 - Therefore, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all of its right, together with the rights of the public generally, in and to the portion of "I" Street lying between the West right of way line of North Harrison Street (formerly Miller Street) and the East right of way line of North Tyler Street (formerly Kavanaugh Street), as shown by the plat of Hollenberg's Addition to the City of Little Rock, which plat is of record in the office of the Circuit Clerk for Pulaski County, Arkansas, in Deed Book 76 at Page 450. Section 2. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all of its right, together with the rights of the public generally, in and to the South 130 feet of the alley in Block 9, Hollenberg's Addition, and in and to the North 200 feet of the alley in Block 16, Hollenberg's Addition to the City of Little Rock. Section 3. Provided, however, the rights of the City of Little Rock and the rights of privately owned utility companies to maintain any existing water, sewer, gas, telephone or power lines in the portions of the street and alleys closed hereunder shall continue to exist and shall not be abolished or affected by this ordinance. Section 4. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the office of the Circuit Clerk and recorded in the deed records of Pulaski County, Arkansas. Section 5. Whereas, the continued existence of the aforesaid - 3 - street and alleys will hinder and delay the construction of additional academic educational facilities for more than 650 elementary school children of the City of Little Rock, an emergency is hereby declared to exist and this ordinance shall take effect and be in force from and after its passage.
