AN ORDINANCE CONDEMNING CERTAIN PARCELS OF
REAL PROPERTY LOCATED IN PULASKI COUNTY,
ARKANSAS TO BE USED FOR THE PURPOSE OF PRO-
VIDING RIGHT -OF -WAY FOR A STREET OR ROADWAY
AND RAILROAD TO SERVE THE PORT OF LITTLE
ROCK SITUATED ON THE ARKANSAS RIVER; DIR-
ECTING THE CITY ATTORNEY TO INSTITUTE CON-
DEMNATION PROCEEDINGS AGAINST SAID PARCELS
OF REAL PROPERTY; REPEALING SUB - PARAGRAPH
2 OF SECTION 1 OF ORDINANCE NO. 11,883; AND
FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The following described parcels of real
property situated in Pulaski County, Arkansas are hereby con-
demned for the purpose of providing street or roadway right -of-
way upon, over and across parcel numbering One (1) and rail-
road right -of -way upon, over and across parcels numbering Two
(2) through Ninteen (19) all to serve the Port of Little Rock
situated on the Arkansas River and the City Attorney is hereby
authorized and directed to file in the proper courts condemna-
tion proceedings against the parcels of said real property
situated in Pulaski County, Arkansas, to -wit:
1. A parcel of land situated in the NEk of Section
18, T -1 -N, R -11 -W of the 5th Principal Meridian,
County of Pulaski, Arkansas, more particularly
described as follows:
Beginning at the northeast corner of Lot 18, Block
H, Factoria Addition to the County of Pulaski,
Arkansas; thence westerly along the north line of
said Lot 18, 50.00 feet to the northwest corner of
said Lot 18; thence southerly along the west line
of said Lot 18, 60.56 feet; thence turn 71 °041
right, 53.53 feet to a point on the east line of
said Lot 18; thence northerly along said east line
of Lot 18, 41.44 feet to the point of beginning
and containing 2,550 square feet, more or less.
2. Lot 9, Block H, Factoria Addition to the City of
Little Rock, Arkansas
3. Lot 10, Block H. Factoria Addition to the City of

The property hereinabove described are necessary for
the purpose of providing a street or roadway right -of -way upon,
over and across parcel numbering One (1) and a railroad right-
of-way upon, over and across parcels numbering Two (2) through
Ninteen (19) all to be constructed and maintained to serve the
Port of Little Rock to be situated on the Arkansas river.

SECTION 2. The City Attorney is further authorized
to secure an Order of the Court allowing the City to take
immediate possession of the property herein described upon
posting of a bond in an amount to be determined by the Court.
The City Attorney is authorized to have posted on behalf of
the City in an amount to be determined by the Court pending
final determination of the condemnation proceedings.
SECTION 3. Sub - paragraph 2 of Section 1 of Ordinance
No. 11,883 is hereby repealed.
SECTION 4. It is hereby found and determined that
immediate possession and control of the property described by
this Ordinance is necessary to enable the City to maintain the
time schedule heretofore established for construction of the
Terminal Facilities for the Port of Little Rock and that failure
to maintain this time schedule can be detrimental to the welfare
of citizens of this city; that an emergency is declared to exist,
and this Ordinance being necessary for the protection of the
public welfare shall be in full force and effect from and after
its passage.
