11939ORDINANCE NO. 119939 AN ORDINANCE AWARDING A CONTRACT TO JAMES H. CONE, INC. FOR THE CONSTRUCTION OF A DRILL TOWER AT FIRE STATION NO. 17; APPROPRIATING THE SUK OF $16,113.69 FROM THE 1965 IMPROVEMENT CONSTRUCTION FUND - FIRE TO PROJECT 65 -F -52; AND FOR OTHER PURPOSES. WHEREAS, invitation to bid was published and bids received pursuant thereto for the construction of a drill tower at Fire Station No. 17 on Doyle Springs Road all in accordance with law; and WHEREAS, the lowest responsible and responsive bid ,, received for said construction was that of James H. Cone, Inc. in the amount of Fifteen Thousand, Seven Hundred Ninety and No /100 Dollars ($15,790.00); and WHEREAS, it is the desire of the Board of Directors to accept said bid of James H. Cone, Inc. and to authorize execution of a contract for the prosecution of the work provided for in accordance with plans and specifications prepared therefor. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The bid of James H. Cone, Inc. in the amount of Fifteen Thousand, Seven Hundred Ninety and No /100 Dollars ($15,790.00) for the construction and installation of a drill tower at Fire Station No. 17 on Doyle Springs Road is hereby accepted and the Mayor and City Clerk are hereby authorized and directed to execute for and on behalf of the City of Little Rock a contract with said James H. Cone, Inc. for the prosecution of the work in accordance with the bidding specifications, plans and bid propos &l on file in the office of the Purchasing Agent in the City of Little Rock. Said contract shall be in form and substance as follows: . r - 2 - SECTION 2. There is hereby appropriated fran the 1965 Improvement Construction Fund -Fire to Project 65 -F -52 in the sum of Sixteen Thousand, One Hundred Thirteen and 69/100 Dollars ($16,113.69) to be used for payment of the contract price for said improvements and other legitimate expenditures authorized in the construction of Fire Station No. 17. SECTION 3. The City Manager and Director of Finance are hereby authorized and directed to issue the necessary warrant or warrants in payment of the contract price upon completion of the work provided by said contract all in accordance with terms, provisions and conditions therein set forth. SECTION 4. This Ordinance shall be in full force and effect from and after its passage. (Here insert any special provisions for liquidated damages relating to failure to complete on time.) As pointed out in Form of Bid, the bidder hereby agrees that the Owner may retain the sum of Fifty Dollars ($50.00) from the amount of compensation to be paid the undersigned for each day after the above mentioned completion date, Sundays and holidays included, that the work remains incomplete. This amount is agreed upon as the proper measure of lidquidated damages which the Owner will sustain per day by the stipulated time, and is not to be construed in any sense as a penalty. FIFTEEN THOUSAND, SEVEN HUNDRED NINETY AND nO/100 DOLLARS BASE BID ......... $15,790.00 ARTICLE 6 PROGRESS PAYMENTS Based upon Applications for Payment submitted to the Architect by the Contractor and Certificates for Payment issued by the Architect, the Owner shall make progress payments on account of the Contract Sum to the Contractor as pro- vided in the Conditions of the Contract as follows: On or about the tenth ( 10th) day of each month ninety (90) per cent of the proportion of the Contract Sum properly allocable to labor, materials and equipment incorporated in the Work and ninety (90) per cent of the portion of the Contract Sum properly allocable to materials and equipment suitably stored at the site or at some other location agreed upon in writing by the parties, up to the twenty —fifth (25th)day of that month, less the aggregate of previous payments I e case; and upon Substantial Completion of the entire Work, a sum sufficient to increase the total payments to nfn� y per cent of the Contract Sum, less such retainages as the Architect shall determine for all incomplete Work and unsettled claims.
