121141 a r j ORDINANCE NO. 12,114 AN ORDINANCE AMENDING SECTION 2 -24 OF THE CODE OF ORDINANCES SAME PROVIDING FOR DISABILITY RETIREMENT BENEFITS FOR NON - UNIFORMED EMPLOYEES; REPEALING SECTION 34 -4 OF THE CODE OF ORDINANCES; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. It shall be the policy of the City of • Little Rock to pay disabled employees of the non - uniformed 0 group retirement pay as hereinafter provided until such time N as a better retirement plan is adopted by the City. This opolicy shall be applicable only to classified regular employees >4 of the non - uniformed group who are compelled to retire from A ra the City's employ because of sickness or permanent disability wgrowing out of an injury incurred in the line of duty. a) Application for disability benefits hereunder must be accompanied by a Physican's certification setting forth the nature of the disability in support of the petition; and further, such employee must submit to a complete examination by the City Health Director. No petition for disability re- tirement hereunder shall be approved except upon a finding by the City Health Director that said applicant is totally and permanently disabled. SECTION 2. (A) If the application of an employee for disability retirement is approved the employee will be paid on a monthly basis and carried on the payroll of the department for which he was employed prior to retirement for a period of months equal to the number of years which the said employee had been employed by the City and for a fractional period of a month to correspond with that fractional period of a year of which he had been employed by the City. Upon the death of the employee, disability benefits payable hereunder shall cease. C, cc -6 �, �6 ` it r -2- (B) The monthly benefits for an employee qualified hereunder shall be the same as his monthly salary rate prior to retirement for the first six (6) months of retirement, less the disability retirement benefits payable to such employee by Mutual of New York. All benefits shall cease after six (6) months unless such employee has been found eligible for retirement under the Social Security program of the Federal Government and if found to be eligible for said Social Security benefits, the monthly payments hereunder shall be in an amount equal to the salary of such employee paid by the City prior to retirement, less retirement benefits payable by Mutual of New York and benefits payable by the Social Security Administration of the Federal Government. SECTION 3. Section 34-4 of the Code of Ordinances of the City of Little Rock is hereby repealed. SECTION 4. This Ordinance shall take effect and be in force from and after its passage.
