12095ORDINANCE NO. 129095 AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR PARTS AND REPAIR TO THE AIR CONDITION- ING SYSTEM IN THE CITY HALL; AUTHORIZING A CONTRACT FOR SAID PARTS AND REPAIR; APPROPRIATING THE SUM OF $5,000.00 FROM THE UNAPPROPRIATED BALANCE OF THE GENERAL FUND; AND FOR OTHER PURPOSES. WHEREAS, the air conditioning system for the City Hall suffered mechanical failure which required immediate repair and for which new parts were not immediately available but for which one source of supply was able to furnish re- conditioned parts immediately; and WHEREAS, the situation created by the failure of said air conditioning system is determined by this Board of Directors to be so exceptional as to justify waiving competitive bidding and to authorize the purchase and the installation of reconditioned parts from the only local source available, namely, Fagan Air Conditioning Company at a cost not to exceed Five Thousand and NO 1100 Dollars ($5,000.00). NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. Fagan Air Conditioning Company is hereby awarded a contract to furnish the necessary parts and install same, including but without being limited to a compressor, for the repair of the air conditioning system for the City Hall, which parts may be reconditioned as opposed to new at a cost not to exceed Five Thousand and NO 1100 Dollars ($5,000.00). SECTION 2. The Board of Directors find and determine that the inability to obtain immediate delivery of new parts necessary for the repair and maintenance of the City Hall air conditioning system creates an emergency and an exceptional situation and, therefore, competitive bidding is hereby waived ti r -2- and based upon the recommendation of the City Manager the negotiated purchase of the reconditioned parts and the in- stallation of same with Fagan Air Conditioning Company of this City is hereby approved. SECTION 3. The sum of Five Thousand and NO /100 Dollars ($5,000.00) is hereby appropriated from the unapprop- riated balance in the General Fund to be used to the extent necessary in paying the cost of labor and parts authorized in Section l hereof. SECTION 4. This Ordinance shall be in full fore and effect from and after its passage. PASSED: June 17, 1968 ATTEST: City Clerk
