12080ORDINANCE NO. 12,080 AN ORDINANCE CONDEMNING CERTAIN PARCELS OF REAL PROPERTY WITHIN THE PROPOSED RIGHT -OF- WAY FOR THE-RECONSTRUCTION AND IMPROVING OF WEST- MARKHAM STREET INCLUDING WITHOUT LIMI- TATION STORM DRAINAGE FACILITIES; DIRECTING THE CITY - ATTORNEY TO INSTITUTE CONDEMNATION - PROCEEDINGS; AND FOR OTHER - PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. - SECTION 1. The City of Little Rock does hereby condemn for street right -of -way and related drainage facilities the fol- lowing parcels of real property situated in the City of Little Rock, Pulaski County, Arkansas, to -wit: A A part of Lot 112, BROOKFIELD SUBDIVISION, City of Little Rock, Pulaski County,- Arkansas, more particu- larly described as follows: A part of Lot 112, BROOKFIELD SUBDIVISION, beginning at the Southwest corner of said Lot 112; thence North 06 034=1411 West along the West line of said Lot 112 • distance of 3.54 feet; thence North 89 °5212611 East • distance of 71.09 feet; thence South 89005154" East • distance of 98.48 feet to the beginning of a tangent curve having a radius of 25.00 feet; thence North- easterly along said curve to the left a distance of 39.75 feet to a point on the East line of said Lot 112; thence South 00010tl411 East along the East line of said Lot 112 a distance of 1.53 feet to the beginning of a tangent curve having a radius of 25.00 feet; thence Southwesterly along said curve to the right a distance of 39.27 feet; thence South 89056114'! West a distance of 170.00 feet to the point of beginning; containing 521.30 square feet, more or less. and A part of Lot 25, BROOKFIELD SUBDIVISION, City of Little Rock, Pulaski County; Arkansas, more particu- larly described as follows: A part of Lot 25, BROOKFIELD SUBDIVISION, beginning at the Southeast corner -of Lot 25; thence North 060341 1411 West along the East line of said Lot 25 a distance of 3.54 feet; thence South 89052126" West a distance of 61.18 feet; thence South 88015106" West a distance of 50.87 feet to the beginning -of a tangent curve having a radius of 25.00 feet; thence Northwesterly along said curve to the right a distance of 40.01 feet to a point on the West line of said Lot 25; thence South 0000311411 East along the West line of said Lot 25 a distance of C -co -63 c-11 -2- 1.81 feet to the beginning of a tangent curve having a radius of 25.00 feet; thence Southeasterly along said curve to the left a distance of 39.21 feet; thence North 89 °56114" East a distance of 112.80 feet to the point of beginning; containing 363.37/feet, more or less. square The aforesaid parcels of real property are needed to be utilized as right -of -way in the construction and reconstruction of West Markham Street in the City of Little Rock and to provide for necessary storm drainage related thereto. SECTION 2. The City of Little Rock does hereby condemn in connection with the reconstruction of the right -of -way and re- lated drainage facilities of West Markham Street in the City of Little Rock temporary easements over and across the following described parcels of land in the City of Little Rock, Pulaski County, Arkansas, to -wit: A A part of Lot 112, BROOKFIELD SUBDIVISION to the City of Little Rock, Pulaski- County, Arkansas, more particularly described as follows: Beginning at a point 3.54 feet North 06034'114" West of the Southwest corner of Lot 112; thence North 890 52126" East 71.09 feet to a point; thence South 89 0051 5411 East 98.48 feet to the beginning of a tangent curve having a radius of 25.0 feet; thence Northeasterly along said curve to the left a distance of 16.09 feet to a point; thence North 89 005154" West 113.52 feet to a point; thence South 89 052126" West 7L70 feet to a point; thence South 06 °3411411 East 5.03 feet to the point of beginning; and containing 900 square feet, more or less. and A part of Lot 25, BROOKFIELD SUBDIVISION to the City of Little Rock, Pulaski- County, Arkansas, more particu- larly described as follows: Beginning at a point 3.54 feet North 06 °3411411 West of the Southeast corner of said Lot 25;- thence South 89 °5212611 West a distance of 61.18 feet to a point; thence South 8801510611 West 50.87 feet to a point which is the beginning of a tangent curve having a radius of 25.0 feet; thence Northwesterly along said curve to the right a distance of 23.18 feet to a point; thence North 88 01510611 East 71.01 feet to a point; thence North 890 5212611 East 60.19 feet to a point; thence South 06 0341 1411 East 10.06 feet to the point of beginning; contain- ing 1,256 square feet, more or less. R -3- The parcels of property identified in this section are being condemned only for a temporary period of time in that they are needed for construction purposes in connection with the re- construction of West Markham Street in the City of Little Rock and said easements shall terminate upon the completion of the construction of this project and the acceptance of the street by the City of Little Rock. SECTION 3. The City Attorney is hereby authorized and directed to file in the proper court proceedings for the condemna- tion of the property described in Sections 1 and 2 hereof, and to secure an order of such court permitting the City to take immediate possession of said property upon posting a bond in an amount to be determined by the court and to do any and all other things necessary in order to obtain immediate possession of said property. SECTION 4. West Markham Street in its present condition is inadequate to accomodate the flow of vehicular traffic utilizing and attempting to utilize said street, thereby causing congestion of traffic thereon and on streets adjacent thereto; and the pro- posed improvement of said street is designed to relieve the con- gestion of traffic thereby enhancing the health, peace and safety of the citizens of the City of Little Rock. Now, therefore, an emergency exists and this Ordinance being necessary to protect the health, peace and safety shall become effective immediately upon its passage.
