WHEREAS, Act 186 of the 1957 General Assembly of the State of Arkansas authorizes cities to prepare and adopt master street plans and WHEREAS, the City of Little Rock is in urgent need of an up -to -date, comprehensive and forward looking plan for adoption as a statement of intent concerning the growth and function of its street and highway pattern, as a framework and guide in further planning and engineering studies, and as a means of securing for the City and its citizens the benefits of an official plan, and WHEREAS, the Little Rock Planning Commission has submitted to the Board of Directors a report of recommendations, in the form of the resolu- M � M tion hereinafter referred to, respecting the establishment of the Master -� Street Plan of the Little Rock Planning Area, and rn � r- WHEREAS, said report was adopted after due notice and public hearing CO • cq,--i as required by law, and ,b WHEREAS, the public health, welfare, morals and safety of the citizens $40 0A of Little Rock will be protected, promoted and benefited by the adoption of 'ob this ordinance, as is more fully set forth in Section 3 hereof. b� NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY a) a OF LITTLE ROCK, ARKANSAS: Section 1. Acceptance of the Report. A resolution adopted by the Little Rock Planning Commission on April 4, 1968 entitled "A Resolution Approving and Adopting the Master Street Plan of the Little Rock Planning Area and Recommending said Plan to the Board of Directors of the City of Little Rock, Arkansas" is hereby accepted as the report and recommendation of said commission respecting the matters therein set forth. Section 2. (a) Adoption of the Plan. There is hereby adopted as a part of the Little Rock Municipal Plan, a Master Plan, which plan is pre- scribed by and reflected on maps and charts, each of which bear the signatures of the Chairman and Secretary of the Little Rock Planning Commission, and further, bear the title "Master Street Plan of the Little Rock Planning Area ". Said maps are identified as follows: (b) The Map in this Section is attached hereto, is made ©co-bJ �.r 600X1037 PAGE516 a part hereof, and shall be as follows: MAP "A►► Said Map together with such maps, charts, documents, ordinances or orders as may from time to time be prepared and adopted, all pursuant to Act 186 of 1957 of the General Assembly of the State of Arkansas, shall be known and may be cited as the "Master Street Plan of the Little Rock Planning Area ". Section 3. Purpose. The major street locations and classifications as herein set forth are made in accordance with a comprehensive design in. order that traffic and circulation of people and goods may be convenient; that safety from traffic hazards and other dangers may be secured; that con- gestion in the public streets may be lessened or avoided; that the process of development may be efficient and economical and that the public safety, morals, order, convenience, prosperity and general welfare of the citizens may be promoted. They are made with reasonable regard for existing condi- tions, the future traffic anticipated along each route, the most desirable location and character for which each facility may be adapted, and the conser- vation of property values throughout the city. Section 4. Establishment of Classification. For the purpose of this ordinance, the streets in the Little Rock Planning Area are divided into seven (7) classifications designated as follows: 1. Residential 2. Residential Collector 3. Collector 4. Arterial 5. Arterial with Median 6� Expressway 7. Freeway The above streets and the location of said streets with the exception of Residential and Residential Collector are hereby established as shown on the plan documents described in Section 2 of this ordinance. Section 5. Planning Specifications. The major streets shown on the plan exist or shall be planned according to the following specifications: This Master Plan is a result of an overall Pulaski County Area Trans- portation Study which was completed in October, 1966. This study has recommended various plans and proposals for transporta- tion needs projected to the year 1990. From extensive study it was revealed that the 278 square mile study -2- 1 . t saox1037 POP area contained a resident population of nearly 223,000 in 1964, who made a total of 758,951 person trips on a typical weekday. In addition, 71,623 external and 70,961 commercial vehicle trips were performed. By 1990, the study area population is expected to reach over 412,000 and 1,761,586 internal trips will be performed daily. The area travel pattern characteristics were obtained from home inter- view surveys, truck -taxi surveys and roadside interviews, the existing street facilities, the existing land use and daily traffic counts. All this data was employed in mathematical projection and trip distribution models which predict future travel patterns. This plan is based on the anticipated "1990" traffic demands which indicate that additional improvements to existing facilities and the con- struction of new transportation facilities are necessary to provide an ade- quate traffic system within the existing Planning Area Boundary of the City of Little Rock. DESIGN CRITERIA The Street classification and design are based on the projected "1990" Average Traffic Assignment. (ADT) Residential Street. 30 MPH design speed, 27 feet of pavement, 50 feet of right -of -way. The Residential Streets' function is to serve as internal access to resi- dential developments. Residential Collector. 30 MPH design speed, 36 feet of pavement, 60 feet of right -of -way. The Residential Collector's primary purpose is to provide ingress and egress to large residential developments. The Residential Collector is not shown or designated specifically in the Master Plan. It will be required at the discretion of the Planning Commission to provide adequate traffic circulation within a residential development. Collector Street. Less than 5,000 ADT, 30 MPH design speed, 41 or 45 feet of pavement, 60 feet of right -of -way. The Collector street system will provide important land service functions to abutting properties, as well as serving traffic between major residential, commercial and industrial facilities; also to connect major Arterial and Freeway systems. 5z oaoY 1037 NAM Arterial. 5,000 to 15,000 ADT, 35 MPH design speed, 45 feet of pavement, 60 feet of right -of -way or 49 feet of pavement in 60 to 70 feet of right -of -way as indicated in the Master Street Plan. Arterial and Divided Median. 15,000 to 22,000 ADT, 40 MPH design speed, 49 feet of pavement, 16 feet of variable median, 80 feet of right -of -way. The primary function of the Arterial is to supplement the Freeway and Expressway system. Expressway. 22,000 or greater ADT, 50 MPH design speed, 150 feet of right -of -way. Expressways are generally considered as an intermediate step between major arterial and freeway facilities. Expressway design precludes direct access to abutting properties, with ingress and egress to roadside development pro- vided by service roads, and a limited number of strategically spaced at -grade intersections. Freeway. 28,000 or greater ADT, 70 MPH design speed, 200 feet of right -of -way. Freeways provide for high speed movement of large volumes of traffic in heavy traffic corridors, with a minimum of interference through the use of access control, divided roadways, and grade- separation interchanges. Intersections. The Planning Commission may require additional right -of -way at the intersections of Arterial and Collector Streets. An intersection will be considered on its own merits at a time of The intersection right -of -way requirement depth of 200 feet from the point of inter cases of planned large scale development, and additional dedication may be required Commission. Facilities shown, noted and designated with the Master Street Plan which are not now physically existing are general locations only, At the time of development 'of areas which include the facility as shown, the Planning Commission will consider the best location in regard to topography and eco- nomics. Section 6. Authority, Jurisdiction and Enforcement. A. Any subdivider of land within the planning area of the Little Rock Planning Commission, who proposes to make or have made a sub- division of land, shall conform to this plan by indicating, on any plats or drawings submitted to said Commission for its consideration, any street identified on this plan which traverses or abuts the said property and shall plat said facility to the width and in the location determined by said Com- mission and shall dedicate so much of said right -of -way not in excess of 120 feet in width. (60 feet either side of the center line) Any right -of -way requirement in excess of 120 feet in width (60 feet on either side of the center line) which is not dedicated at that time shall be reserved for future acquisition by the City of Little Rock. Such acquisition must be made within twelve (12) months from the date the final plat is filed for record with the Office of the Pulaski County Circuit Clerk. Further acquisition shall be deemed as having been made when either an option to purchase is executed or suit to condemn is filed by the City of Little Rock; provided, however, no subdivider shall be denied the privilege of having a plat approved solely by reason of the issue of reserved right -of -way unless the City determines and advises said subdivider within sixty (60) days from the date his plat is presented to the Little Rock Planning Commission that public funds for ac- quisition will be available within twelve (12) months from the date plat is so presented. B. Whenever the Little Rock Planning Commission is presented with a request for consideration of a plat involving any facility shown or described in the Master Street Plan, the Commission will determine the exact location and extent of right -of -way necessary for the,provisions of said facility, and shall require, in conjunction with the approval of the pre - 'liminary plat, the dedication or reservation of the right -of -way as stipulated, or shall recommend for consideration by the Board a proposal to alter the 50 Boox1037 DGE520 location by amendment to this plan. C. In all cases wherein subdivision and development or resub- division and development of land is involved, no building permit shall be issued for the construction of any new building, or for an addition to an existing building, or for the moving of any building, on any lot or parcel of land which is traversed by or abuts any indicated street facility unless it has first been determined that the proposed structure would not lie within the proposed bounds of said facility. D. In all situations other than where land is being subdivided and developed, no lot or parcel of land which lies within the right -of -way of a proposed street shall be privately developed or shall any permit be issued authorizing such until the City of Little Rock shall have refused to execute a written option or to file suit for condemnation to acquire said area. Such refusal shall be given by the City of Little Rock within one year of the date such action is requested by the property owner;- provided, however, no property owner shall be denied the privilege of developing such lot or parcel of land by reasons of the provisions of this ordinance unless the City determines and. advises such property owner within sixty (60) days from the date of request for action that public funds for the acquisition will be available within twelve (12) months from the date of request for such action by said property owner. E. No provision of this ordinance shall be construed to deny, a permit for the remodeling, repair or maintenance of an existing building not involving structural alteration or for the use of said lot or parcel for pur- poses not involving the construction or relocation of buildings. F. The Master Street Plan of the Little Rock Planning Area shall I i be duly considered prior to action on any matter related thereto which comes lbefore the Little Rock Planning Commission, this Board or any of the depart - 1 ments, agencies, boards of commissions of this City. Section 7. Repealing Clause. Ordinance No. 10,929 and parts of Ordinances in conflict herewith are hereby repealed. i Section 8. Recording. A copy of this ordinance, together with the maps and charts referred to herein, shall be filed in the Office of the Recorder of Pulaski County as required by Act 186 of 1957 of the General Assembly of the State of Arkansas. goox1037 PAGE521 Section 9. Severability. If any section, clause, paragraph, pro- vision, or portion of this ordinance or plan shall be held invalid or uncon- stitutional by any court of competent jurisdiction, such holding shall not affect any other section, clause, paragraph, provision or portion of this ordinance or plan.
