12070ORDINANCE NO. 12,070 AN ORDINANCE GRANTING TO JAMES HUDSON DISABILITY RETIREMENT BENEFITS UNDER SECTION 2 -24 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK APPROPRIATING FUNDS FOR SAID PURPOSE; AND FOR OTHER PURPOSES. WHEREAS, James Hudson was employed by the City of Little Rock on March 27, 1956, and has been continuously employed until the present time, when due to a physical disability, is found to be entitled to disability retire- ment benefits to become effective on April 21, 1968, compris- ing a term of employment of 12 years and 24 days; and WHEREAS, under Section 2 -24 of the Code of Ordinances of the City of Little Rock it is the policy of the Board of Directors to continue to pay disabled employees at his rate of pay on the date of retirement and in this case, for a period of 12 months and 24 days commencing April 21, 1968; subject, however, to deductions from said monthly pay equal to the sums hereinafter received from James Hudson or to which he would be entitled, provided he filed proper applic- ation provided under the non - uniformed employment plan, to- gether with such funds as shall be received hereinafter monthly by said James Hudson or that which he would receive had proper application been filed, if any, as disability benefits under the social security administration program of the United States of America. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The City Manager and Director of Finance are hereby authorized and directed to continue the salary established for James Hudson as of April 21, 1968, and to pay A -2- same to him monthly in the nature of disability retirement benefits beginning April 21, 1968, for a period of 12 months and 24 days at such time as James Hudson shall become eligible to receive and shall, in effect receive benefits under the non - uniformed benefits plan of the City and upon receiving disability benefits under the social security laws of the United States of America the Director of Finance shall deduct from monthly payments authorized hereunder all sums received during said month from the foregoing sources so that the sum received monthly by him from all sources of disability income shall be equal to, but shall not exceed his monthly salary. SECTION 2. At such time, if ever, that James Hudson shall become eligible to receive benefits on either or both the non - uniformed employees retirement plan of the City of Little Rock and/or the social security laws of the United States of .America, and fails or refuses to make application therefor, the benefits provided for by this Ordinance shall cease and no further payments shall be made to him pursuant to authority of this ordinance. N SECTION 3. The sum of $2,458.00 is hereby appropriated from the unappropriated balance of the General Fund to the Building Maintenance Salary-Account of the Public Works Department to provide funds for the payment of disability herein authorized for the remainder of the calendar year of 1968 and the Budget Ordinance of the City of Little Rock is hereby amended to reflect such appropriation.
