120461 w I ORDINANCE NO. 129046 AN ORDINANCE CREATING A MUNICIPAL TOLLWAY AUTHORITY AND SPECIFYING ITS POWERS, AUTHORITY, RESPONSIBILITIES AND OBLIGATIONS; PRESCRIBING OTHER MATTERS PERTAINING THERETO; AND DECLARING AN EMERGENCY. WHEREAS the City of Little Rock, Arkansas (the "City ") is a city of the first class under the laws of the State of Arkansas and has a; determined to proceed under Act No. 33 of the First Extraordinary Session N of the Sixty -Sixth General Assembly of the State of Arkansas, approved rq February 20, 19 6 8 ("Act No. 33") to create a municipal tollway authority; ro o NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of the City of Little Rock, Arkansas: ra a) Section 1. That under and in pursuance of the authority con - a� a: Q) ferred by Act No. 33, there be, and there is hereby, created a municipal tollway authority, designated "Little Rock Tollway Authority" (the "Authority ") . Section 2. That R. A. Lile; Jack T. Lynn, Sr., Max Mehlburger, Sr., Dan Phillips and Moise B. Seligman, Jr. be, and they are hereby, appointed as members of the Authority to serve as follows: One for a term of one year; one for a term of two years; one for a term of three years; one for a term of four years; and one for a term of five years, to be determined by lot at the first meeting of the Authority. When determined, there shall be filed in the office of the Secretary of the Authority and in the office of the City Clerk of the City a statement of the term of each member. Upon expiration of the respective terms, successor members of the Authority shall be appointed by the remaining members, subject to the approval of the Board "9. of Directors of the City, and each such .appointee shall serve for a term of 0 oo -& F_ -3 t Page 2 five years. In the event of a vacancy occurring on the Authority, the remaining members of the Authority shall, subject to the approval of the Board of Directors -of the City, appoint a member to serve the unexpired term. All members of the Authority must be qualified electors of the City and each shall file the oath required by law in the State of Arkansas for public officials. Section 3. The Authority shall have all powers, authority, responsibilities and obligations included and set forth in Act No. 33, it being the intention of this Ordinance to vest in the Authority the powers, authority, responsibilities and obligations of a tollway authority with reference to tollway projects within the City. To this end, the Authority is hereby authorized and directed to do any and all things, execute any and all documents and instruments and perform all acts of whatever nature necessary to effect and carry out the authority conferred by Act No. 33 and by this - Ordinance, or to evidence that authority and its exercise. Section 4. That the provisions of this Ordinance are hereby declared to be separable, and if any section, phrase, or provision shall for any reason be declared to be invalid, such declaration shall not affect the validity of the remainder of the sections, phrases and provisions. Section 5. That all ordinances, resolutions and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. Section 6. That there is hereby found and declared to be an immediate need to make available transportation facilities to keep abreast of the transportation requirements of the citizens, which are essential to the welfare, safety and prosperity of the City and its citizens and-inhabi- tants; that Act No. 33, as implemented by this Ordinance, offers an opportunity to discharge this essential public responsibility which should z w t Page 3 be fully explored and implemented; and that the realization of the public benefits sought to be accomplished by this Ordinance depend upon the prompt undertaking of the authority conferred hereby. It is, therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of the public health, safety and welfare shall be in force and take effect immediately upon and after its passage.
