12030r � ORDINANCE NO. 129030 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, THAT THE ALLEY THROUGH BLOCK 61 WOODRUFF'S ADDITION, LITTLE ROCK, ARKANSAS, BE CLOSED, VACATED AND ABANDONED. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 16th day of January, 1968, asking the Board of Directors to vacate and abandon all of the alley in Block 5, Woodruff's Addition to the City of Little Rock, as designated on the plat of said Addition now appearing of record in Deed Book AB, page 210, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easements in said alley, and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley hereinbefore described, has heretofore been dedicated to the public use as an alley as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley to be vacated have filed with the Board of Directors their written consent to such abandon- ment; and that public interest and welfare will not be adversely af- fected by the abandonment of such alley; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of 062a _4 -"- C -.s-' the public generally, in and to the alley designated as follows: The remaining portion of the alley in Block 5, Woodruff's Addition, Little Rock, Arkansas, lying between lots 1, 2, 3 and 4 (except that portion of lot 4 in Highway Right -of -Way) and lots 12, 11, 10 (except that part of lot 10 in Highway Right -of -Way) subject, however, to any public utility easements located in said alley, and provided no structure shall be built over the conduit of the Southwestern Bell Telephone Compny lying under said alley without the permission of Southwestern Bell Telephone Company. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County.
