ORDINANCE NO. 11,974 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING A PORTION OF COLLINS STREET LYING BETWEEN BLOCKS 1 AND 5 OF RUSSELL'S ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 7th day of September, 1967, asking the Board of Directors to vacate and abandon a portion of Collins Street lying between Blocks 1 and 5 of Russell's Addition to the City of Little Rock, more particularly described as follows: All that part of Collins Street in the City of Little Rock which is bounded on the South by the North line of East Markham Street and which is bounded on the North by the right of way of the main track of the Missouri Pacific Railroad; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notices, heard all persons desiring to be heard on the question and has ascertained that the portion of the street, hereinbefore described, has heretofore been dedicated to the public use as a street; that the portion of the street, hereinbefore described, has not been actually used by the public generally for a period of at least five (5) years prior to the filing of the plat; that all of the owners of the property abutting upon the street to be vacated have filed with the Board of Directors their written consent to an abandonment; and that the public interest and welfare will not be adversely affected by the abandonment of such portion of the street; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons its rights, together with the rights of the COO - /4-,l public generally, in and to the street designated as follows: All that part of Collins Street in the City of Little Rock which is bounded on the :youth by the North line of East Markham Street and which is bounded on the North by the right of way of the main track of the Missouri Pacific Railroad, subject, however, to any public utility easements located in said street. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
