11962� r ORDINANCE NO. 119962 AN ORDINANCE GRANTING CONSENT FOR THE ARKANSAS NATIONAL GUARD AND OTHERS TO PERMIT THE UNITED STATES TIME CORPORATION TO USE AND OCCUPY, WITHOUT PREJUDICE TO THE CITY, THE ARKANSAS NATIONAL GUARD, OR OTHERS, PORTIONS OF CERTAIN PROPERTY DEEDED BY THE CITY OF LITTLE ROCK TO THE STATE OF ARKANSAS, FOR THE USE AND BENEFIT OF THE ARKANSAS NATIONAL GUARD, AND FOR OTHER PURPOSES: WHEREAS, by lease contract dated December 31, 1931 the City of Little Rock leased to Arkansas Valley Compress & Warehouse Company, a corporation, certain described property at the Little Rock Airport, including Building No. 19, which lease contract is still in full force and effect and provides that in the event the United States Government should surrender, either temporarily or permanently, certain space reserved by it in Building No. 19, (now known as Section M) the right to occupy and use such space under the terms of the lease should belong to the Lessee, and WHEREAS, by Ordinance No. 5413 passed January 28, 1937, the Mayor and City clerk of Little Rock were ordered and directed to deed to the State of Arkansas certain property at the Little Rock Airport, including Section M of Building No. 19, said ordinance providing that the property was to be for- ever used by the State solely for aviation purposes and the Arkansas National Guard and that any attempt to pass title or dispose of the property should void the deed and such property and appurtenances thereunto belonging should revert to the City of Little Rock, and WHEREAS, by Quitclaim Deed dated. January 29, 1937, recorded in Deed Book 319 at Page 460, the City of Little Rock 0 did remise, release and forever quitclaim unto the State of Arkansas, for the use and benefit of the Arkansas National Guard, certain described lands, including Section M of Building GCo -s'I F- Ic No. 19 at the Little Rock Airport, and WHEREAS, by lease dated February 24, 1947, as amended May 28, 1947, Arkansas Valley Compress & Warehouse Company leased to The United States Time Corporation certain properties, including portions of Building No. 19, said lease providing that if possession of Section M should ever be restored to the Lessor, the Lessee should have the option to lease Section M on specified terms, and WHEREAS, The United States Time Corporation has need for additional space in Building No. 19 and the use of the additional space by The United States Time Corporation will promote the welfare of the City of Little Rock through increasing employment and payroll and the Arkansas Valley Compress & Warehouse Company, the Arkansas National Guard and the City of Little Rock are willing to cooperate in promoting the general welfare of the City of Little Rock, but without prejudice to or loss or impairment of any of their respective existing rights, and have negotiated a proposed agreement for these purposes, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Arkansas National Guard, the Little Rock Municipal Airport Commission, and the Arkansas Valley dompress & Warehouse Company are hereby granted eonsent and permission of the City of Little Rock, Arkansas to permit, on terms substantially like those in the Agreement attached as Exhibit A, the use and occupancy by The United States Time Corporation of all or portions of said Section M of Building No. 19 at the Little Rock Municipal Airport, as referred to in Ordinance No. 5413, passed January 28, 1937; provided, however, that the permission for such use and occupancy shall - 2 - not extend beyond December 31, 1981. SECTION 2. That the consent and permission of the Arkansas National Guard to the aforesaid use and occupancy by The United States Time Corporation shall not be in any way deemed violative of Section 2 of Ordinance No. 5413, passed January 28, 1937, shall not be deemed a disposition of the property to The United States Time Corporation, and shall not prejudice any rights of Arkansas Valley Compress & Warehouse Company under its lease contract dated December 31, 1931, but such use and occupancy shall be subject to the conditions contained in the deed dated July 15, 1936 conveying the Airport property from the United States of America to the City of Little Rock. SECTION 3. Emergency Clause. That it is hereby found and determined by the Board of Directors of the City of Little Rock, Arkansas that The United States Time Corporation has immediate need for the additional space in Building 19, that such immediate use will promote the welfare of the City of Little Rock through increasing employment and payroll and making some income available to the Little Rock Municipal Airport Commission, and that, therefore, an emergency is declared to exist and this Ordinance being necessary for the immediate preservation of the public peace, health and safety, shall be in full force and effect from and after its passage and approval.
