ORDINANCE NO. 12, 262
A ORDINANCE WAIVING COMPETITIVE BIDDING
FOR PARTS AND REPAIR TO AN ALLIS- CHALMERS
TRACTOR DOZER HD -16 -DP USED BY THE
SANITATION DEPARTMENT; AUTHORIZING A
CONTRACT FOR SAID PARTS AND REPAIR; AND
FOR OTHER PURPOSES.
WHEREAS, an Allis - Chalmers tractor dozer HD -16 -DP in use
by the Sanitation Department has suffered mechanical failure
which must be repaired immediately; and
WHEREAS, the only source of supply for parts necessary to
make the repairs is Clark Equipment Company, Inc. of Little Rock,
Arkansas; and
WHEREAS, the situation created by the limited source of
supply for the repair parts and the necessity for immediately
making said repairs creates an exceptional situation which this
Board of Directors determine to justify waiving competitive
bidding and, therefore, desire by this Ordinance to award a
contract to Clark Equipment Company, Inc. to furnish parts and
make repairs to said tractor dozer at a cost to the City not to
exceed the sum of Five Thousand Eight Hundred Thirty -four Dollars
and fifty -five cents ($5,834.55).
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. Clark Equipment Company, Inc. is hereby awarded
a contract to furnish the necessary parts and make repairs to the
Allis- Chalmers tractor dozer HD -16 -DP used by the Sanitation
Department at a cost not to exceed Five Thousand Eight Hundred
Thirty -Four Dollars and fifty -five cents ($5,834.55).
SECTION 2. The Board of Directors find and determine
that the limited source of supply for the parts needed to repair
the tractor herein identified and the necessity for making said
repairs immediately creates an emergency and an exception situa-
tion and, therefore, competitive bidding is hereby waived.

SECTION 3. There is hereby appropriated the sum of $5,834.55 from the
unexpended balance of the General Fund to Sanitation Budget Account Noe 154 -404
Maintenance of Heavy Equipment, to cover the above authorized repairs.
SECTION 4. This Ordinance shall be in full force and effect from and after
its passage.
