12202ORDINANCE NO. 12,202 AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL ALLEYS IN BLOCKS 1, 2, 3 AND 4 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS; ALL OF WEST THIRTEENTH STREET BETWEEN THE EAST RIGHT OF WAY LINE OF CLARY STREET TO THE WEST RIGHT OF WAY LINE OF COOLIDGE STREET; ALL OF SHIELD STREET BETWEEN THE NORTH RIGHT OF WAY LINE OF WEST FOURTEENTH STREET TO THE SOUTH RIGHT OF WAY LINE OF WEST TWELFTH STREET; AND ALL OF COOLIDGE STREET BETWEEN THE SOUTH RIGHT OF WAY LINE OF WEST TWELFTH STREET TO THE SOUTHEAST CORNER OF BLOCK 4 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULAS KI COUNTY, ARKANSAS. WHEREAS, a Petition was duly filed by the Housing Authority of the City of Little Rock with the Board of Directors of the City of Little Rock, Arkansas, asking the Board of Directors to vacate, abandon and close portions of West Thirteenth Street, Shield Street and Coolidge Street and the alleys in Blocks 1, 2, 3 and 4 of Cansler's Addition to the City of Little Rock, Pulaski County, Arkansas, same being more particularly described in said Petition and hereafter; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that said Streets and alleys are no longer needed or required for corporate purposes or for use by the general public and adjoining owners, in that other streets and alleys are avail- able or will be made available for these purposes; that Petitioner Housing Authority of the City of Little Rock, Arkansas is the only owner of lands abutting upon the streets and alleys to be vacated in these proceedings; and accordingly all abutting landowners have consented to such abandonment, and that the public interest and welfare will not be adversely affected by the abandonment thereof; Page 2 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its: rights, together with the rights of the public generally, in and to West Thirteenth Street, Shield Street and Coolidge Street and the alleys in Blocks 1, 2, 3 and 4 of Cansler's Addition to the City of Little Rock, Pulaski County, Arkansas, more particularly described as follows: Page 3 ALL OF THE ALLEYS IN BLOCKS 19 2, 3 AND 4 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS; ALL OF THIRTEENTH STREET BETWEEN THE EAST RIGHT OF WAY LINE OF CLARY STREET TO THE WEST RIGHT OF WAY LINE OF COOLIDGE STREET, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHWEST CORNER OF BLOCK 3 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, RUN THENCE EAST ALONG THE NORTH BOUNDARY LINE OF SAID BLOCK 3 TO THE NORTHEAST CORNER OF SAID BLOCK 3, THENCE EAST 30 FEET TO THE NORTHWEST CORNER OF BLOCK 4 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, THENCE EAST ALONG THE NORTH BOUNDARY LINE OF BLOCK 4 TO THE NORTHEAST CORNER OF SAID BLOCK-4. THENCE NORTH 30 FEET TO THE SOUTHEAST CORNER OF BLOCK 1 OF CANSLER'S ADDI- TION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, THENCE WEST ALONG THE SOUTH BOUNDARY LINE OF BLOCK 1 TO THE SOUTHWEST CORNER OF BLOCK 1, THENCE WEST 30 FEET TO THE SOUTHEAST CORNER OF BLOCK 2 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, THENCE WEST ALONG THE SOUTH BOUNDARY OF BLOCK 2 TO THE S OUTHWE S T CORNER OF BLOCK 2, THENCE SOUTH 30 FEET TO THE POINT OF BEGINNING; ALL OF SHIELD STREET BETWEEN THE NORTH RIGHT OF WAY LINE OF WEST FOURTEENTH STREET AND THE SOUTH RIGHT OF WAY LINE OF WEST TWELFTH STREET, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF BLOCK 3 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, THENCE NORTH ALONG THE EAST BOUNDARY OF BLOCK 3 TO THE NORTHEAST CORNER OF BLOCK 3, THENCE NORTH 30 FEET TO THE SOUTHEAST CORNER OF BLOCK 2 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, THENCE NORTH ALONG THE EAST BOUNDARY OF BLOCK 2 TO THE NORTHEAST CORNER OF BLOCK 2, THENCE EAST THIRTY FEET TO THE NORTHWEST CORNER OF BLOCK 1 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, THENCE SOUTH ALONG THE WEST BOUNDARY LINE OF BLOCK I TO THE SOUTHWEST CORNER OF BLOCK 1, THENCE SOUTH 30 FEET TO THE NORTHWEST CORNER OF BLOCK 4 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, THENCE SOUTH ALONG THE WEST BOUNDARY LINE OF BLOCK 4 TO THE SOUTHWEST CORNER OF BLOCK 4, THENCE WEST 30 FEET TO THE POINT OF BEGINNING; ALL OF COOLIDGE STREET BETWEEN THE SOUTH RIGHT OF WAY LINE OF WEST TWELFTH STREET TO THE SOUTHEAST CORNER OF BLOCK 4 OF CANSLER'S ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS; Page 4 and ownership thereof except as to utility easements provided for in Section 2 hereafter shall be vested in the Petitioner herin in the manner according to law. Section 2. That the rights now held by any public utility company, under the laws of the State of Arkansas or under grants heretofore made by the City of Little Rock, Arkansas, to use the streets and alleys as described above in Section 1, for the location and operation of lines and facilities for the furnishing of public utility services shall not be abrogated, diminished or changed by the enactment of this Ordinance, and utility easements now in effect are specifically excepted from this closing. Section 3. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. Section 4. The redevelopment of the lands now owned by Petitioner, Housing Authority of the City of Little Rock, Arkansas, as part of its urban renewal project, will be seriously delayed if said streets and alleys are not closed and vacated immediately. An emergency is therefore declared to exist and this Ordinance being necessary for the immediate preservation of the public welfare shall take effect immediately upon its passage and approval.
