AN ORDINANCE CONDEMNING AN EASEMENT OVER AND
ACROSS CERTAIN LANDS LOCATED IN THE CITY OF
LITTLE ROCK FOR THE PURPOSE OF GRADING THE
SLOPE ADJACENT TO THE RIGHT -OF -WAY OF WEST
MARKHAM STREET, RESODDING THE AREA SO GRADED,
RECONSTRUCTION OF DRIVEWAYS IN CONNECTION
WITH THE IMPROVEMENT AND RECONSTRUCTION OF
WEST MARKHAM STREET IN THE CITY OF LITTLE
ROCK; DIRECTING THE CITY ATTORNEY TO INSTITUTE
PROPER CONDEMNATION PROCEEDINGS TO CARRY OUT
THE INTENT AND PURPOSE HEREOF; AND FOR OTHER
PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The City of Little Rock does hereby condemn
an easement for the purpose of sloping the grade and sodding the
area and reconstructing driveways over and across the following
described parcel of real property situated in the City of Little
Rock, Arkansas:
A part of Lot 1, YANCY SUBDIVISION to the City of
Little Rock, Pulaski County, Arkansas, and more
particularly described as follows:
Beginning at the Northwest corner of said Lot 1;
thence Southerly along the West I ne of said Lot
1, 12.0 feet; thence Easterly 9.0 feet; thence
Southerly 35.0 feet; thence Easterly 31.0 feet;
thence Northerly 35.0 feet; thence Easterly 27.0
feet; thence Southerly 35.0 feet; thence Easterly
33.0 feet to a point on the East line of said Lot
1; thence Northerly along said East. line 47.0 feet
to the Northeast corner of said Lot 1; thence
Westerly along the North line of Lot 1, said North
line being the South right -of -way line of West
Markham Street, to the point of beginning. Said
parcel contains 3,400 square feet, more or less.
The aforesaid easement is necessary to provide the proper
sloping and grading adjacent and abutting the right -of -way of West
Markham Street in the City of Little Rock, Arkansas, and to pro-
vide for the reconstruction of driveways across said easements to
match and connect existing driveways and new street grades.
SECTION 2. The easement hereby condemned shall terminate
on the completion of the reconstruction of West Markham Street and
the acceptance of such reconstruction project by the City of
Little Rock.

SECTION 3. The City Attorney is hereby authorized and
directed to file in the proper Court proceedings for the condem-
nation of the easement the description of which is set out in
Section 1 hereof, and to secure an order of such Court allowing
the City to take immediate possession of such easement as described
upon its posting bond in an amount to be determined by the Court,
and to do any and all other things reasonably necessary in obtain-
ing immediate right of entry to the property to which said easement
is contained.
SECTION 4. Whereas, it is found and determined that the
reconstruction of West Markham Street in the City of Little Rock
will be delayed and that the construction of said street cannot
be performed in such a manner as to allow the safe movement of
vehicular traffic along such street. in the absence of the sloping
and sodding of the property herein described to match new street
grades and that the acquisition of the easement herein described
will expedite the proper reconstruction of West Markham Street
thereby enhancing public peace, health and safety of the citizens
of this community. Therefore, an emergency is hereby found to
exist and this Ordinance being necessary in the implementation and
construction of adequate facilities for the safe movement of
vehicular traffic along West Markham Street shall be in full force
and effect from and after its passage.
