12380ORDINANCE NO. 12,380 AN ORDINANCE AWARDING CONTRACT FOR THE CONSTRUCTION OF A BUILDING AT THE CITY MATERIALS YARD;APPROPRIATING THE SUM OF $106,980.00 FROM A SPECIAL ACCOUNT IN THE STREET FUND; AUTHORIZING PA)IENT; AND FOR OTHER PURPOSES WHEREAS, invitation for bids was duly advertised and bids received pursuant thereto according to law for materials and labor and the construction of a building in the materials yard for the City of Little Rock; and WHEREAS, the lowest responsible and responsive bid has been determined and it is the desire of the Board of Directors to authorize a contract for said building to the lowest responsible and responsive bidder. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The lowest responsible and responsive bid for the furnishing of all labor and materials and constructing a building at the materials yard for the City of Little Rock is hereby approved and a contract is hereby awarded to Rock Steel Building Company at a cost not to exceed $106,980.00, which contract shall be in form and substance as follows: -� 17 I . r C 0 N T R k C T THIS CONTRACT AND AGREEMENT, made and entered into this day of — _ , 19_ , by and between Party of the First Part; and Party of the Second Part, C'ITNESSETH: That for and in consideration of the payment to be made as hereinafter set forth, the Party of the First Part hereby agrees to furnish all tools, labor, equipment, and materials, and to build and construct in exact accord with the Plans on file in the office of the _ , Little Rock, Arkansas, designated as _ _, and with the copy of said Plans, Specifications, and Proposal being attached hereto and made a part hereof as fully as though copied in full herein, under the direct supervision, and to the entire satisfaction of the _ _ __ , subject to inspection at all times in accordance with the laws of the State of Arkansas. It is agreed and understood between the parties hereto that the Party of the First Part agrees to accept and the Party of the Second Part agrees to pay for the work at the prices stipulated in said Proposal, such payment to be in lawful money of The United States, and the payment shall be made at the time and in the manner set forth in the Specifications. The Party of the First Part agrees, for the consideration above expressed, to begin work within ten days after being ordered to begin work by the Engineer, and to complete the work within _ _ ____ (_ _) days. If the Party of the First Part shall fail to complete the work in the time herein specified, he shall pay to the Party of the Second Part, as liquidated damages, ascertained and agreed, and not in the nature of a penalty, the sum of ($_ ) for each day delayed, which shall be deducted from the final amount of Estimate made by the Contractor. Upon completion of the aforementioned construction complying in all respects with bidding specifications and bid proposals the City Manager and Director of Finance are hereby authorized and directed to execute the necessary warrant or warrants in payment of the contract price herein provided for.
