ORDINANCE NOS 12, 320
AN ORDINANCE CONDEMNING AN EASEMENT OR A
TEMPORARY CONSTRUCTION RIGHT -OF -ENTRY ACROSS
CERTAIN LANDS LOCATED IN THE CITY OF LITTLE
ROCK FOR THE PURPOSE OF FACILITATING INGRESS
AND EGRESS FOR THE PROPOSED ASHER AVENUE -
ROOSEVELT ROAD INTERSECTION RECONSTRUCTION;
DIRECTING THE CITY ATTORNEY TO INSTITUTE PRO-
PER CONDEMNATION PROCEEDINGS TO CARRY OUT THE
INTENT AND PURPOSE HEREOF; AND FOR OTHER
PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The City of Little Rock does hereby condemn an
easement for the purpose of providing a temporary construction right -of-
entry over and across the following described parcels of real property
situated in the City of Little Rock, Arkansas:
1. Tract No. 8 -E
Part of Lot 5, Block 14 of R. C. Butler's Addi-
tion to the City of Little Rock, and part of
abandoned Twenty- eighth Street, Pulaski County,
Arkansas, more particularly described as follows:
Beginning at the point of intersection of the
existing West right -of -way line of Pine Street
and the existing North right -of -way line of Asher
Avenue; thence South 63° 22' West along the exist-
ing right -of -way line of Asher Avenue a distance
of 151.7 feet to a point; thence North 260 38' West
a distance of 11.0 feet to a point; thence North
610 44' East a distance of 70.0 feet to a point;
thence South 260 38' East a distance of 7.5 feet
to a point; thence North 630 22' East a distance of
84.6 feet to a point on the existing West right -of-
way line of Pine Street; thence South 6.2 feet to
the point of beginning, and containing 1,298 square
feet, more or less.
2. Tract No. 9 -E
Part of Lot 6, Block 15 of R. C. Butler's Addition
to the City of Little Rock, Pulaski County, Arkansas,
more particularly described as follows: Beginning
at the point of intersection of the existing East
right -of -way line of Pine Street and the existing
North right -of -way line of Asher Avenue; thence
North along the existing right -of -way line of Pine
Street a distance of 5.6 feet to a point; thence
North 630 22' East a distance of 38.5 feet to a
point; thence North 210 23' East a distance of 13.5
feet to a point; thence North 630 22' East a distance
of 30.0 feet to a point; thence South 26 38' East a
distance of 14.0 feet to a point on the existing
North right -of -way line of Asher Avenue; thence South
630 22' West along said existing right -of -way line a
distance of 81.1 feet to the point of beginning and
containing 700 square feet, more or less.

3. Tract No. 13 -E
Part of Lot 6, Block 15 of R. C. Butler's Addition
to the City of Little Rock, Pulaski County, Arkansas,
more particularly described as follows: Beginning
at the point of intersection of the East line of
Lot 6, Block 15 of R. C. Butler's Addition and the
existing North right- of-way line of Asher Avenue;
thence South 630 22' West along said existing
right-of-way line a distance of 5.0 feet, more or
less, to a point; thence North 280 22' East a
distance of 8.7 feet, more or less, to a point on
the East line of said lot; thence South a distance
of 4.0 feet, more or less, to the point of beginning
and containing 12 square feet, more or less.
The aforesaid easement is necessary to provide the proper
ingress and egress for the proposed Asher Avenue - Roosevelt Road Inter-
section reconstruction.
SECTICN 2. The easement hereby condemned shall terminate on
the completion of the reconstruction of the Asher Avenue - Roosevelt Road
Intersection and the acceptance of such reconstruction project by the City
of Little Rack and its Assigns.
SECrICN 3. The City Attorney is hereby authorized and direc-
ted to file in the proper Court proceedings for the condemnation of the
easement, the description of which is set out in Section 1 hereof, and to
secure an order of such Court allowing the City and its Assigns to take imrediate
possession of such easement as described upon its posting bond in an amount to
be determined by the Court, and to do any and all other things reasonably
necessary in obtaining immediate right-of-entry to the property to which
said easement is contained.
SECrICN 4. Whereas, it is found and determined that the re-
construction of Asher Avenue - Roosevelt Road Intersection in the City of
Little Rock will be delayed and that the construction of said street cannot
be performed properly or in a manner which will allow the safe movement of
traffic along such streets without the necessary ingress and egress to said
properties and that the acquisition of the easement herein described will
expedite the proper reconstruction of the Asher Avenue - Roosevelt Road
Intersection, thereby enhancing public peace, health and safety of the
citizens of this ccm unity. Therefore, an emergency is hereby found to
exist and this Ordinance, being necessary in the implementation and

construction of adequate facilities for the safe movement of vehicular
traffic at the Asher Avenue - Roosevelt Road Intersection, shall be in
full force and effect from and after its passage.
