12315�r ORDINANCE NO. 12,315 AN ORDINANCE VACATING, ABANDONING AND CLOSING PORTIONS OF CERTAIN STREETS AND ALLEYS LOCATED IN DUNSCOMB'S WEST 12TH STREET ADDITION, KENNILWORTH ADDITION, COX'S SUBDIVISION, JOSEPHINE PANKEY ADDITION, AND WEST END SUBDIVISION, ALL BEING ADDITIONS TO THE CITY OF LITTLE ROCK, ARKANSAS, IN CONFORMANCE WITH THE PROVISIONS OF THE URBAN RENEWAL PLAN FOR THE UNIVERSITY PARK URBAN RENEWAL PROJECT, PROJECT ARK R -51; AND FOR OTHER PURPOSES. WHEREAS, under the provisions of Resolution No. 3166, duly adopted by the Board of Directors of the City of Little Rock, Arkansas, on June 6, 1964, the Urban Renewal Plan of the Housing Authority of the City of Little Rock, Arkansas, for the University Park Urban Renewal Project, Project No. ARK R -51, was formally approved; and WHEREAS, said Board of Directors in said Resolution found that in order to implement and facilitate the effectuation of said Urban Renewal Plan, certain official action must be taken by the Board of Directors, including the vacation and removal of streets, alleys and other public ways, the establishment of new street patterns, changes in zoning, and the location and relocation of sewer and water mains and other public facilities, all as provided in said Plan; and WHEREAS, the objectives of said Plan have now been sufficiently attained to require that official action be taken to vacate, close and abandon the herein- after described portions of certain streets and alleys in Dunscomb's West 12th Street Addition, Kennilworth Addition, Cox's Subdivision, Josephine Pankey Addition, and West End Subdivision, all being Additions to the City of Little Rock, Arkansas, and all located in Pulaski County, Arkansas; and WHEREAS, said portions of said streets and alleys are no longer needed for use as streets and alleys for travel by motor vehicle, pedestrian or other traffic, and for means of access to other lands, and are accordingly no longer needed for corporate purposes; and WHEREAS, under said Urban Renewal Plan provisions are made for other suitable, safe, adequate and convenient means of access to.and egress from the area involved; and WHEREAS, in order to better provide for the public welfare, safety, comfort and convenience of the general public, the inhabitants of the City of Little Rock, Arkansas, and the users of said streets and alleys, it is necessary to vacate, close and abandon those portions of streets and alleys hereinafter specifically described; � -1 �r Page 2 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That it is hereby ascertained and declared that the use, as public streets and alleys, of those portions of the hereinafter described streets and alleys located in Dunscomb's West 12th Street Addition, Kennilworth Addition, Cox's Subdivision, Josephine Pankey Addition, and West End Subdivision, all being Additions to the City of Little Rock, Pulaski County, Arkansas, are no longer necessary and needed by adjoining landowners, the general public and for access to other lands in the vicinity; that other streets and routes are presently in existence or will be constructed pursuant to said Urban Renewal Plan which reason- ably, safely and adequately serve the needs of those members of the public, traveling to and from areas now or previously served by said portions of the above mentioned streets and alleys; that said portions of said streets and alleys should accordingly be vacated, abandoned and closed, and all of the right, title and interest of the City of Little Rock, Arkansas, in the said vacated portions of said streets and alleys should revert to the adjoining landowners. SECTION 2. That the City of Little Rock, Arkansas, under its powers as set forth in Arkansas Statutes (1947) Section 19 -2304, and Section 19 -3029, hereby vacates, abandons and closes the following described streets and alleys and relinquishes, grants and conveys unto the adjoining landowners all of the right, title and interest of the City of Little Rock, Arkansas, of its inhabitants, and the public generally, in said streets and alleys, to -wit: All of Clary Street, running generally north and south from the South right -of -way line of West Twelfth Street to the South right -of -way line of West Sixteenth Street. All of Cox Street running generally north and south from the South right -of -way line of West Twelfth Street to the South right -of -way line of West Fourteenth Street. All of Caruth Street running generally north and south from the South right -of -way line of West Twelfth Street to the centerline of Rock Creek. A platted dedicated street running generally north and south from the South right -of -way line of West Twelfth Street to the centerline of Rock Creek between Block 3 of West End Subdivision and Blocks 1 and 2 of Cox's Subdivision, and also between Block 5 of West End Subdivision and Block 1 of Josephine Pankey Addition. All of West Thirteenth Street and West Fourteenth Street running generally east and west from West right -of -way line of Clary Street to the East right -of -way line of Vogler Street. All of West Fifteenth Street running generally east and west from West right -of -way line of Caruth Street to centerline of Rock Creek between Blocks 1 and 2, Josephine Pankey Addition. R Page 3 All of the alleys running generally east and west in Blocks 1 and 2, in Dunscomb`s West Twelfth Street Addition and Blocks 1 and 2 in Kennilworth Addition. Alley running generally east and west in Block 1, Cox`s Subdivision. Alley running generally north and south from the South right -of -way line of West Fourteenth Street to the centerline of Rock Creek in Blocks 1 and 2, Josephine Pankey Addition. That portion of West Sixteenth Street from the centerline of Rock Creek to the East right -of -way line of Clary Street. SECTION 3. The rights now held by any public utility company, under the laws of the State of Arkansas or under grants heretofore made by the City of Little Rock, Arkansas, to use the streets and alleys as described above in Section 1, for the location and operation of lines and facilities for the furnishing of public utility services shall not be abrogated, diminished or changed by the enactment of this Ordinance, and utility easements now in effect are specifically excepted from this closing; provided that there is specifically reserved in favor of Arkansas Power & Light Company, its successors and assigns, an easement and right -of -way for the installation of electrical distribution and service lines over, through and across the West 10 feet of that portion of Caruth Street being vacated, abandoned and closed hereby as described hereinabove. SECTION 4. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the Deed Records of said County. SECTION 5. The redevelopment of the lands located within the Additions to the City of Little Rock, Arkansas, described above, which are within the University Park Urban Renewal Project of the Housing Authority of the City of Little Rock, Arkansas, will be seriously delayed if said streets and alleys are not closed and vacated immediately. An emergency is therefore declared to exist, and this Ordi- nance being necessary for the immediate preservation of the public welfare, shall take effect immediately upon.its passage and approval. SECTION 6. The Board of Directors finds that this Ordinance is enacted at the request of the Housing Authority of the City of Little Rock, Arkansas, and Lewis S. Rauton, as the sole owners of all lands adjoining and abutting upon the streets and alleys being closed hereby; and accordingly this Ordinance is enacted with the unanimous approval of the owners of all lands adjoining and abutting upon the streets and alleys being closed hereby.
