ORDINANCE OF THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS, VACATING AND
CLOSING PARTS OF THE STREETS IN UNIVERSITY
HEIGHTS (ASHTON PARK) ADDITION TO THE CITY
OF LITTLE ROCK, ARKANSAS
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas, on the 29th day
of October
, 1969, asking the Board of Directors to vacate
and abandon parts of streets in University Heights (Ashton Park)
Addition to the City of Little Rock, as designated on the plat
of said Addition now appearing in Plat Book 1, page 93, and
Plat Book 1, page 107, in the Office of the Recorder of Pulaski
County, Arkansas.
WHEREAS, after due notice as required by law, the
Board of Directors has, at the time and place mentioned in the
notice, heard all persons desiring to be heard on the question
and has ascertained that the streets hereinafter described have
heretofore been dedicated to the public use as streets as herein
described; have not been actually used by the public generally
for a period of at least five (5) years subsequent to the filing
of the plat; that all of the owners of the property abutting on
the portion of the streets to be vacated have filed with the Council
their written consent to such abandonment; and that public interest
and welfare will not be adversely affected by the abandonment of
such streets; and it is in the best interest of the City of Little
Rock to vacate said streets.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas hereby
releases, vacates and abandons all its rights, together with the
rights of the public generally, in and to the streets designated
as follows:
That part of Canis Street lying in the NE4 SA
of Section 27, Township 2 North, Range 13 West,
extending eastward from the Northwest corner of
Lot 8, Block 8, to the Northeast corner of Lot 1,
Block 7, and that part of Ewe Street extending
southward from the North boundary line of
the Northeast quarter Southwest quarter of
said SEction 27 to the Southeast corner of
Lot 1, Block 8 and the Southwest corner of
Lot 12, Block 7.
SECTION 2. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the Office of the Recorder of
Pulaski County, Arkansas and recorded in the Deed Records of the
County.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage.
