12504ORDINANCE NO. 12,504 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING, ABANDONING AND - CLOSING THE EAST -WEST ALLEY LOCATED WITHIN BLOCK 178, ORIGINAL CITY OF LITTLE ROCK, ARKANSAS. - WHEREAS, a Petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 17th day of May, 1971, asking the Board of Directors to vacate and abandon all of the East-West alley located within Block 178, Original City of Little Rock, as appearing on plat attached to the Petition filed herein, subject, however, to any public utility easements in said alley; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that the alley, hereinbefore described, is now longer needed or required for corporate purposes or for use by the general public and adjoining owners in that other streets and alleys are available and used for these purposes ; that Petitioners are the only abutting land owners upon said alley to be closed herein and accordingly all abutting land owners have consented to such abandonment, and that the public interest and welfare will not be adversely affected by the abandonment thereof; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the East -West alley heated within Block 178, Original City of Little Rock, described as follows: An East-West alley extending across the middle of Block 178, Original City of Little Rock, Arkansas, being parallel to West Capitol Avenue and West Sixth Street, and running from State Street through said Block 178, Original City of Little Rock, to Gaines Street. n _�l subject, however, to any public utility easements located within said alley; and that theownership thereof except as to such utility easements, if any, shall vest in the owners of the abutting property. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the Deed Records of the County. SECTION 3. This Ordinance shall take effect and be in force from and after its passage.
