124790 M .4 rl O �o M N 0 rn l0 M M M M ri r{ � �4 O O b rd N a) r_1 rd M 0 N 0) a r • r ORDINANCE NO. 12,479 AN ORDINANCE AMENDING SUBSECTION (H) OF SECTION 43.21 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK PERTAINING TO PARKING AREAS: AND FOR OTHER PURPOSES NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The Board of Directors of the City of Little Rock recognizes the increasing amount of urban land being utilized for the purpose of providing off- street parking. In order to provide a more attractive urban environment, and to lessen the visual impact of areas devoted to the parking and storage of automobiles and other wheeled vehicles, it is declared to be in the public interest for the citizens of Little Rock to establish minimum requirements and standards for the planting and landscaping of such parking areas. SECTION 2. Subsection (H) of Section 43.21 of the Code of Ordinances is hereby amended by adding subparagraph (f) as provided: (f) Following the adoption of this ordinance every parking area developed which contains 3,500 square feet or more must provide at least 1 tree or 1 attrac- tively landscaped area planted with perennial shrubs and plants for every 3,500 square feet, or major portion thereof. When such parking areas adjoin two or more streets, the trees and /or planting areas shall be arranged so that all street frontages receive an equal amount of trees or landscaping. No more than 507. of the total required landscaping and /or plantings shall be located within the public right -of -way. The remainder shall be uniformly distributed throughout the parking area. The owner or leasee of the parking area shall be responsible for the main- tenance of all such trees and planting areas. An attractively landscaped area shall contain not less than 14 square feet. The trees shall be a minimum of twelve feet in height unless such height conflicts with other City ordinances, and two inches in caliper. For purposes of complying with this ordinance, trees may. be planted in that portion of public right -of -way adjacent to the parking area which is not being used as a street. Failure of the City to issue a permit to plant trees in compliance with this subparagraph (s 43.21 (H) (f) will entitle the owner or developer to a waiver of the requirements of this subparagraph. Such a COO - -71 F, - /a w waiver to be granted by the Director of the Department of Community Development. All trees planted hereunder shall comply with the specifications of Little Rock Ordinance No. 12,029 February 19, 1968 and all shrubs shall be evergreen and not less than 3 feet in height within one (1) year after planting.
