ORDINANCE NO. 12,700
AN ORDINANCE AMENDING CHAPTER 43 OF THE CODE OF
ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS,
ADDING ARTICLE VI, ESTABLISHING A ZONING PLAN
FOR THE CENTRAL LITTLE ROCK URBAN RENEWAL PROJECT,
ARK R -12; AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Section 43 -2 of the Code of Ordinances of
the City of Little Rock, Arkansas, is hereby amended to read as follows:
(1) Districts - In order to regulate and restrict the location of
buildings and other structures and of premises to be used for trade, industry,
residence or other specified uses, to regulate and limit the height and bulk of
buildings'and other structures hereafter erected or altered, to regulate and
determine setback building lines and the area of yards and other open spaces,
the City of Little Rock, Arkansas, with the exception of the Central Little Rock
Urban Renewal Area as outlined in Article VI of this chapter, is hereby divided
into districts of which there shall be nineteen (19), known as:
"A "- One - family District
"B "- Residence District
"C "- Two - family District
"MF 6" Multi- family District
"MF 12" Multi - family District
"MF 18" Multi- family District
"MF 24 Multi - family District
"D "- Apartment District
"E "- Apartment District
"MR" Mobile Home District
"E -1" Quiet Business District
"E -1 -A" Nursing Home, Lodging,
"F "- Commercial District
"G "- Commercial District
"G -1" Commercial District
"H "- Business District
"I" Light Industrial District
"J" -Light Industrial District
"K "- Heavy Industrial District
and Undertaking District
(2) The City of Little Rock, Arkansas, with the exception of the
aforementioned area, is hereby divided into nineteen (19) districts aforesaid and
the boundaries of such districts are shown on the official zoning map on file in
the office of the city clerk and made a part of this chapter, being designated as
the "District Map ", and said map and all the notations, references and other
information shown thereon shall be as much a part of this chapter as if the
matters and information set forth by said map were fully described herein.
(3) Except as hereinafter provided:
(a) No building shall be erected, converted, reconstructed,
or structurally altered nor shall any building or land
be used for any purpose other than is permitted in the
district in which such building or land is located.
(b) No building shall be erected, converted, reconstructed,
or structurally altered to exceed the height or bulk
limit herein established for the district in which such
building is located.
(c) No building shall be erected, converted, reconstructed,
or structurally altered so as to intrude upon the area
required for the front, side, rear, interior, or
exterior yards as herein established; provided further
that no yard or open space on adjoining property shall
be considered as providing a yard, open space, or access
for a lot wherever a building is to be erected.

(d) No lot area shall be so reduced or diminished that
the yards or other open spaces shall be smaller
than prescribed by this chapter, nor shall the
density of population be increased in any manner
-except in conformity with the area regulations as
hereinafter provided.
(e) Every building hereafter erected shall be located
on a lot as herein defined and in no case shall
there be more than one building on one lot except
as hereafter provided.
(f)' All use, height and area, parking, and other such
regulations pertaining to the Central Little Rock
Urban Renewal Area shall be as outlined in Article VI
of this chapter.
SECTION 2. That Section 43 -22 of the Code of Ordinances of
the City of Little Rock, Arkansas is hereby amended by adding a subsection to be
numbered(4)(1),which said subsection reads as follows:
(1) To review requests for variances and conditional use permits
as specified in Article VI of this chapter.
SECTION 3. That Chapter 43 of the Code of Ordinances of the
City of Little Rock, Arkansas is hereby amended by adding an article to be
numbered VI, which said article reads as follows:

Renewal Project, ARK R -12
SECTION 43 -33. Boundaries of the Central Little Rock Urban
Renewal Project, ARK R -12
Central Little Rock Urban Renewal Project ARK R -12 is bounded
on the North by the centerline of the Arkansas River, on the East by the center-
line of the Little Rock -North Little Rock Expressway extended to the centerline
of the Arkansas River and by the centerline of the Little Rock -North Little Rock
Expressway, on the South by a line commencing at a point where the South right -
of -way line of Fifteenth Street extended intersects with the centerline of the
Little Rock -North Little Rock Expressway; thence West along the South right -of -way
line of Fifteenth Street extended and the South right -of -way line of Fifteenth
Street to the West right -of -way line of McAlmont Street; thence North along the
West right -of -way line of McAlmont Street to the South right -of -way line of
Fifteenth Street; thence West along the South right -of -way line of Fifteenth
Street to a point where the South right -of -way line of Fifteenth Street inter-
sects with the West right -of -way line of Broadway Street; thence North along
the West right -of -way line of Broadway Street to the South right -of -way line of
Eleventh Street; thence West along the South right-of-way line of Eleventh Street,
to the East right -of -way line of Arch Street; thence North along the East right -of-
way line of Arch Street to the North right -of -way of Eighth Street; thence East
along the North right -of -way line of Eighth Street to the West right -of -way line
of Broadway Street; thence North along the West right -of -way line of Broadway
Street and of Broadway Street extended to the centerline of the Arkansas River.
All lands lying within these boundaries are included in the
project and may be referred to in the Plan as "Central Little Rock ", the "project
area", or as the "Central Little Rock Urban Renewal Project ".
The District Map which is part of this Ordinance establishes
the perimeter boundary of the project and the zoning districts. Boundaries shown
on the map conform with the description according to established features given
above.
SECTION 43 -34. Uses to be permitted. The permitted uses of
lands within Central Little Rock are listed by Use Groups, and these Use Groups
are permitted only within designated Zoning Districts.

mapped according to the following Zoning Districts:

(g) The air rights and subterranean rights within the
Public Right -of -Way may be used according
to the permitted uses within adjacent Districts but
subject to a conditional use permit, and a franchise
agreement with the City of Little Rock.
Wherever lands within the Public Right -of -Way are
not official public rights -of -way, these lands may
be used according to the permitted uses within the
adjacent District.
SECTION 43 -35. Permitted Uses and Parking and Loading
(1) (a) Parking Requirements. There shall be provided for
each use in any District the number of off - street
parking spaces required for that use in subsection
(2) below, except that in the Metrocentre district
no spaces shall be required. All required spaces
shall be off - street parking.
(b) Off- Street Loading Requirements. On the same premises
with every building, structure or part thereof here-
after erected, established or enlarged and occupied
for manufacturing, storage, warehouse, goods display,
department store, wholesale store, market, hotel,
mortuary, laundry, dry cleaning, schools, auditorium,
hospitals, churches, office buildings, or other uses
involving the receipt or distribution by vehicles of
materials, or merchandise, or people; there shall be
provided and maintained adequate space for standing,
loading, and unloading in order to avoid undue inter-
ference with public use of the street or alley.
The minimum off - street loading space required shall
include a loading space which measure 12 feet by 30
feet with a 14 foot height clearance for every 20,000
square feet or fraction thereof in excess of 3,000
square feet of floor and land area used for the above -
mentioned purposes. This required off - street loading
space shall be in� addition to an area or means adequate
for ingress, egress, and maneuvering.

SECTION 43 -36. Building and Area Requirements. In any
District set forth in this Article, any use of land shall be subject to the bulk
and area controls established in the following tables subject to possible excep-
tions or modifications through the final approval of either a conditional use
permit, an application for a Planned Development, or a variance. In the follow-
ing tables all limits are minimums, except site coverage and floor area ratio
which are maximums.
Floor Area Ratio is the total floor area exclusive of enclosed
parking space divided by the land area. When applied to residential or mixed use
buildings, residential floor area shall be used to compute Floor Area Ratio.
Total floor area is the area of floor space within the outside dimensions of a
building including each floor level, halls, lobbies, stairways, elevator shafts,
basement, covered exterior balconies, and covered open space.
Open Space Ratio is the area of open space divided by the
total floor area. Open space is the total horizontal area of all uncovered open
space (land area minus building area plus usable roof area).
Livability Space Ratio is the area of livability space (open
space minus open car space minus one -half the ground area of any carports)
divided by the total floor area.

(3) Bulk and Area Requirements in the Public and Institutional
District. The bulk and area requirements in the Public and Institutional
district shall conform to those requirements for the General Business district.
. SECTION 43 -37. Conditional Use Permit. A conditional use
permit may be granted by the Board of Adjustment of the City of Little Rock
upon written application from the property owner or his authorized agent and
after submission of a site development plan. In granting a conditional use
permit, the Board of Adjustment shall impose such requirements and conditions,
including bulk and area requirements, in addition to those expressly stipu-
lated in this Article for the particular use, as the Board may deem necessary
for the protection of adjacent properties and the public interest. The Board
should be cognizant of the intent of section 43 -45, "Historic and Architectural
Preservation ", of this Article. On each application for a conditional use permit
the Housing Authority will submit a recommendation upon request by the Board of
Adjustment.
SECTION 43 -38. Planned Development. A Planned Development
is an area of land controlled by a landowner to be developed as a single
entity, the plan for which does not conform in every respect with the regula-
tions relating to permitted uses, lot area, lot widths, lot coverage, yards,
open space, bulk of buildings, or improvements established elsewhere in this
Article for the District in which such land is located.
To qualify as a Planned Development, the land must be a
tract (1) which either has an area of at least 90,000 square feet or is pro-
posed to be developed for fifty or more dwelling units, (2) which is under
single ownership, and (3) for which an application for a Planned Development
is made to the Planning Commission and includes a site development plan.
Planned Developments are authorized to be established in the following districts:
High Density Residential; Medium Density Residential; Neighborhood Commercial;
and Public and Institutional. On each application for the Planned Development,
the Housing Authority will submit a recommendation upon request by the Planning
Commission. Planned Developments may be granted by the City Board of Directors
subsequent to a public hearing and a recommendation from the Planning Commission.
SECTION 43 -39. Variances. Variances from the literal
provisions of bulk and area and parking and loading requirements may be granted
by the Board of Adjustment, when it is demonstrated that said variances are in
keeping with the objectives of this Article.
SECTION 43 -40. Reclassifying Use Districts.
(1) Additional areas may be included in the Metrocentre district,
subject to a public hearing, recommendation by the Planning Commission, and
approval by the City Board of Directors, provided the following requirements are
met:
(a) The land must cover either a minimum area of 90,000
square feet or one city block exclusive of any alley.
(b) The area must be adjacent to, not diagonal from, the
Metrocentre district.
(c) Site development plans are submitted to the,Planning
Commission.
(2) Additional areas may be included in the General Business
district subject to a public hearing, recommendation by the Planning Commission,
and approval by the City Board of Directors provided the following requirements
are met:
(a) The land covers either a minimum area of 45,000 square
feet or one -half a city block exclusive of any alley.
(b) The area is adjacent to, not diagonal from, the General
Business district.
(c) Site development plans are submitted to the Planning
Commission.

(3) Additional lands may be included within the High Density
Residential district subject to a public hearing, recommendation by the
Planning Commission, and approval by the City Board of Directors provided
the following requirements are met:
(a) The land covers either a minimum area of 909000
square feet or one city block exclusive of any alley.
(b) The area is adjacent to, not diagonal from, the High
Density Residential district.
(c) Site development plans are submitted to the Planning
Commission.
As used in this section, the phrase "adjacent to" shall mean the
same as either "contiguous to" or "directly across a public right -of -way from."
SECTION 43 -41. Amending Use Groups. It shall be the
authority of the Board of Directors of the City of Little Rock to add new uses
to use groups on recommendation by the Planning Commission.
SECTION 43 -42. Nonconforming Uses and Structures.
(1) Uses: Existing lawful use of land which does not conform to
the provisions of this Article may be continued, or expanded if approved by the
Board of Adjustment, but if such nonconforming use is discontinued for a period
of 12 consecutive months any future use of said land shall be in conformity with
the provisions of this Article.
Existing lawful use of a nonconforming building or structure may be
continued although such building does not conform with the provisions hereof,
and such use may be extended throughout the building provided no structural
alterations, except those required by law or ordinance, are made therein. If
no structural alterations are made, the use in a nonconforming building may be changed
to another nonconforming use of the same or more restricted classification. If
such nonconforming building is removed every future use of such land shall be in
conformity with this Article.
The foregoing provisions shall also apply to nonconforming uses in
districts hereafter changed.
Nothing in this section shall be deemed to prevent the restoration
of a building destroyed to the extent of not more than 75 per cent of the physical
structure, exclusive of foundations, (before such damage is repaired) as deter -
minded by the Building Official of the City of Little Rock, by fire, explosion,
or other casualty, or the public enemy, nor the continued occupancy or use of such
building or part thereof which existed at the time of such partial destruction.
(2) Buildings: A nonconforming building
shall be structurally added to or extended only under the following conditions, or
with approval of the Board of Adjustment:
(a) The use to which said building is put conforms to the
district in which it is located.
(b) That any accessory building located on the lot conforms
to all requirements of this Article and the building code.
(c) The total lot area occupied by a building after the
erection, conversion, reconstruction or structural
alteration and the lot area occupied by existing
encroachments, extensions or projections into a required
yard space shall not exceed the total lot area allowed
by this Article for new construction.
(d) That no part of the existing nonconforming building shall
encroach, extend or project into more than forty per cent
(40 %) of any one (1) side yard distance required by this
Article.

(e) That no part of the existing nonconforming building
shall encroach, extend or project into more than
thirty per cent (30 %) of either the front or rear
yard distance required by this Article.
(f) That no part of the existing nonconforming building
shall encroach, extend or project into more than
one yard space distance required by this Article.
(g) That such erection, conversion, reconstruction or
structural alteration shall fully conform to the
yard space and all other applicable provisions of
this Article required for new construction.
SECTION 43 -43. Rights -of -Way and Easements. Only tentative
locations for proposed street and highway rights -of -way are shown on the District
Map. The final location cannot be fixed until the improvements are designed for
construction.
Streets and other public rights -of -way or easements which
are not shown to be vacated or to be closed may be subject to vacation or
closing through the due process of law.
The easements within the public rights -of -way shown to be
vacated may be retained or vacated as deemed proper by the City Board of
Directors.
Any public rights -of -way which may be vacated and abandoned
by the City of Little Rock shall assume the designation of the contiguous
zoning district to the centerline of the public right -of -way as shown on the
District Map.
SECTION 43 -44. Signs. This Article does not regulate signs
or any means of advertising which are subject to other regulations of the City
of Little Rock or the State of Arkansas, except such regulation of signs as may
be imposed by the Board of Adjustment when granting a conditional use permit or
by the City Board of Directors when granting a Planned Development.
SECTION 43 -45. Historic and Architectural Preservation.
Owners and developers of properties which are recognized as historically or
architecturally significant, should endeavor to preserve and enhance the
architectural and historic qualities of these properties.
SECTION 43 -46. Conflicting Regulations. Wherever, the pro-
visions of this Article conflict with other regulations of the City of Little
Rock with regards to the use of structures or land, or to the height or bulk of
structures, or to the size of open spaces or yards, or to the parking and load-
ing requirements, the more restrictive shall apply. All other ordinances of the
city will apply.
SECTION 4. This ordinance shall be in full force and effect
from and after its passage.
