ORDINANCE NO. 12,712
AN ORDINANCE VACATING, ABANDONING AND CLOSING
THE NORTH -SOUTH ALLEY LOCATED WITHIN BLOCK 104,
ORIGINAL CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a Petition was duly filed by First National, Inc. , Metropolitan
Trust Company, Samuel L. Raines and Twilla Ann Harper, with the Board of
Directors of the City of Little Rock, Arkansas, asking the Board of Directors
to vacate, abandon and close the North -South alley located within Block 104,
Original City of Little Rock, Arkansas, same being more particularly described
in said Petition and hereafter; and
WHEREAS, after due notice as required by law, the Board of Directors
has, at the time and place mentioned in the Notice, heard all persons desiring
to be heard on the question and has ascertained that said North -South alley
located within Block 104, Original City of Little Rock, Arkansas, is no longer
needed or required for corporate purposes or for use by the general public and
adjoining owners in that other streets and alleys are available and used for
these purposes; and
WHEREAS, petitioners, First National, Inc. and Metropolitan Trust
Company, are the only abutting landowners upon said North -South alley located
within Block 104, Original City of Little Rock, Arkansas, to be vacated and
accordingly all abutting landowners have consented to such abandonment, and
that the public interest and welfare will not be adversely affected by the abandon-
ment thereof, petitioners Samuel L. Raines and Twilla Ann Harper having conveyed
their property in said Block to petitioner First National, Inc. subsequent to the
filing of the Petition, and First National, Inc. being at this time the owner of the
entire Block with the exception of Lots 7 and 8 which are owned by Metropolitan
Trust Company;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The City of Little Rock, Arkansas, under its powers including
those set forth in Arkansas Statutes (1947) §19-2304, hereby vacates, abandons
and closes the North -South alley located within Block 104, Original City of
Little Rock, Arkansas, said alley which is hereby vacated, abandoned and closed
being more particularly described as follows:
Beginning at the Northeast corner of Lot 1, Block
104, Original City of Little Rock, Arkansas; run
thence South along the West right of way line of
the North -South alley located within Block 104,
Original City of Little Rock, Arkansas, to the
Southeast corner of Lot 6, Block 104, Original
City of Little Rock, Arkansas; run thence East along
North right of way line of West Fifth Street (Capitol
Avenue) to the Southwest corner of Lot 7, Block 104,
Original City of Little Rock, Arkansas; run thence
North along the East right of way line of the North -
South alley located within Block 104, Original City
of Little Rock, Arkansas, to the Northwest corner
of Lot 12, Block 104, Original City of Little Rock,
Arkansas; run thence West along the South right of
way line of West Fourth Street to the point of beginning.
(Same being also described as: All of the North -South
alley located within Block 104, Original City of Little
Rock, Arkansas) .
And the City of Little Rock, Arkansas hereby relinquishes unto the adjoining
landowners, First National, Inc. and Metropolitan Trust Company, their successors
and assigns, all of the right, title and interest of the City of Little Rock, Arkansas,
and of its inhabitants, and the public generally, in respect to said alley which
is vacated, abandoned and closed as aforesaid, the right, title and interest
being relinquished to Metropolitan Trust Company pertaining solely to the East
1/2 of said alley adjoining the West boundary line of Lots 7 and 8 presently
owned by Metropolitan Trust Company.
Section 2. The rights now held by any public utility company, under
the laws of the State of Arkansas or under grants heretofore made by the
City of Little Rock, Arkansas, to use the North -South alley located within
Block 104, Original City of Little Rock, Arkansas, as described in Section 1
above, for the location and operation of lines and facilities for the furnishing
of public utility services, shall not be abrogated, diminished or changed by
the enactment of this Ordinance, and utility easements now in effect are

specifically excepted from this closing.
Section 3. A copy of this Ordinance, duly certified by the City Clerk,
shall be filed in the office of the Recorder of Pulaski Coutny, Arkansas, and
recorded in the deed records of said County.
Section 4. All ordinances or parts of ordinances in conflict herewith
are hereby repealed.
