12746ORDINANCE NO. 12,746 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE ALLEY IN BLOCK 23, BELLEVUE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 14th day of December , 1972, asking the Board of Directors to vacate and abandon the alley in Block 23, BELLEVUE ADDITION to the City of Little Rock, as designated on the plat of said addition now appearing of record in Plat Book 1, Page 251, in the office of the Recorder for Pulaski County, Arkansas, subject, however, to any public easement in said street; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mention- ed in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley, herein - above described, has heretofore been dedicated to the public use as an alley, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley to be vacated have filed with the Board of Directors their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the abandon- ment of such alley; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, to- gether with the rights of the public generally, in and to. the alley designated as follows: An alley 20' wide lying, in its entirety, between Lots 1 through 6 on the North and Lots 7 through 12 on the South, all in Block 23, BELLEVUE ADDITION, now in the City of Little Rock. CCO -''A F-11 i. subject, however, to any public utility easements located in said alley. SECTION 2. A copy of this Ordinance, duly certi- fied by the City Clerk, shall be filed in the office of the Recorder for Pulaski County and recorded in the Deed Records of the County. SECTION 3.
