AN ORDINANCE VACATING, ABANDONING AND CLOSING
THE NORTH -SOUTH ALLEY LOCATED WITHIN BLOCK 43,
ORIGINAL CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a Petition was duly filed by Housing Authority of the
City of Little Rock, Arkansas with the Board of Directors of the City of
Little Rock, Arkansas, asking the Board of Directors to vacate, abandon
and close the North -South alley located within Block 43, Original City
of Little Rock, Arkansas, the same being more particularly described in
said Petition and hereafter; and
WHEREAS, after due notice as required by law, the Board of
Directors has, at the time and place mentioned in the Notice, heard all
persons desiring to be heard on the question and has ascertained that said
North -South alley located within Block 43, Original City of Little Rock,
Arkansas, is not needed or required for corporate purposes or for use by
the general public and adjoining owners, it not being physically opened at
the present time and has not been for a long period of time; and
WHEREAS, Petitioner, Housing Authority of the City of Little Rock,
Arkansas, is the only abutting landowner upon said North -South alley located
within Block 43, Original City of Little Rock, Arkansas to be vacated and
accordingly all abutting landowners have consented to such abandonment,
and the public interest and welfare will not be adversely affected by the
abandonment thereof, said Block 43, Original City of Little Rock, Arkansas,
being the site for the Housing for the Elderly Apartment Project, ARK 4 -10, of
Petitioner;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The City of Little Rock, Arkansas, under its powers
including those set forth in Arkansas Statutes (1947) § 19 -2304, hereby vacates,

abandons and closes the North -South alley located within Block 43, Original
City of Little Rock, Arkansas, said alley which is hereby vacated, abandoned
and closed being more particularly described as follows:
Beginning at the Northeast corner of Lot 1,
Block 43, Original City of Little Rock, Arkansas;
run thence South along the West right of way
line of the North -South alley located within
Block 43, Original City of Little Rock, Arkansas,
to the Southeast corner of Lot 6, Block 43,
Original City of Little Rock, Arkansas; run
thence East along the North right of way line
of East 9th Street to the Southwest corner of
Lot 7, Block 43, Original City of Little Rock,
Arkansas; run thence North along the East
right of way line of the North -South alley
located within Block 43, Original City of
Little Rock, Arkansas, to the Northwest
corner of Lot 12, Block 43, Original City
of Little Rock, Arkansas; run thence West
along the South right of way line of East 8th
Street to the point of beginning. (Same being
also described as: All of the North -South alley
located within Block 43, Original City of Little
Rock, Arkansas.)
And the City of Little Rock, Arkansas hereby relinquishes unto the adjoining
landowner, Housing Authority of the City of LittleRock, Arkansas, all of the
right, title and interest of the City of Little Rock, Arkansas, and of its inhabi-
tants, and the public generally in respect to said alley which is vacated,
abandoned and closed as aforesaid.
Section 2. In that said alley is not presently physically in existence
and there are no utility facilities using same, there is no reservation provided
for herein for utility easements to remain in effect as none are in existence.
Section 3. A copy of this Ordinance, duly certified by the City
Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas,
and recorded in the deed records of said County.
Section 4. All ordinances or parts of ordinances in conflict herewith
are hereby repeated.
