RESOLUTION NO. 11,825
3 A RESOLUTION TO APPOINT COMMISSIONERS TO FILL
4 THREE VACANCIES ON THE BOARD OF COMMISSIONERS
5 OF THE PECAN LAKE MUNICPAL RECREATIONAL
6 IMPROVEMENT DISTRICT #4; AND FOR OTHER PURPOSES.

8 WHEREAS, the Pecan Lake Municipal Recreational Improvement District #4 (the
9 "District ") was created by the Little Rock Board of Directors in Little Rock, Ark. Ord. #
10 17,310 (November 7, 1996) and
11 WHEREAS, three property owners were appointed Commissioners of the
12 District; and
13 WHEREAS, two of the property owners moved out of the District and were
14 replaced by the Board of Directors in Little Rock, Ark. Res. No. 11,424 (January 7, 2003);
15 and
16 WHEREAS, Ark. Code Ann. X14 -88 -302 requires commissioners to file an oath of
17 office with the City Clerk within ten days of appointment; and
18 WHEREAS, it was recently discovered that neither the one remaining original
19 commissioner nor the two replacement commissioners filed their oaths within the ten
20 day time frame; and
21 WHEREAS, Ark. Code Ann. X14 -88 -302 states that if the commissioner should
22 fail to file the oath within ten days then the city council shall at once appoint another
23 person having the like qualifications in their place.
24 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
25 THE CITY OF LITTLE ROCK, ARKANSAS:

I Section 1. The following three persons who are property owners within the
2 District are hereby appointed to serve as Commissioners of Pecan Lake Municipal
3 Recreational Improvement District #4: Mrs. Evelyn Rose, 5918 Timberview Rd., Little
4 Rock, AR 72204; Mr. A.G. Krippendorf, 5918 Tall Pine Blvd., Little Rock, AR 72204; Mrs.
5 Mary L. Rogers, 2 Timberside Cove, Little Rock, AR 72204.
6 Section 2. Said appointees shall file an oath of office with the City Clerk within
7 10 days of their appointment, or by September 24, 2004.
8 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
9 clause, phrase, or word of this resolution is declared or adjudged to be invalid or
10 unconstitutional, such declaration or adjudication shall not affect the remaining
11 portions of the ordinance which shall remain in full force and effect as if the portion so
12 declared or adjudged invalid or unconstitutional was not originally a part of the
13 ordinance.
14 Section 4. Repealer. All ordinances and resolutions are hereby repealed to the
15 extent of such inconsistency.
