129101n N 0 M b O A ra a) rd a� a a) Z ORDINANCE NO 12,910 AN ORDINANCE ABOLISHING THE BOARD OF COMMISSIONERS OF FRATERNAL CEMETERY AS NOW CONSTITUTED; AMENDING SECTION 10 -18 OF THE CODE OF ORDINANCES TO PROVIDE FOR THE CREATION OF THE BOARD OF COMMISSIONERS OF FRATERNAL CEMETERY; APPROVING THE PROPOSAL OF OAK- LAND CEMETERY TO PROVIDE ASSISTANCE TO FRATERNAL CEMETERY; APPROPRIATING FUNDS TO BE USED FOR MAKING CAPITAL IMPROVEMENTS TO FRATERNAL CEMETERY; AND FOR OTHER PURPOSES BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The Board of Commissioners of Fraternal Cemetery as constituted under provisions of Section 10 -18 of the Code of Ordinances is hereby abolished. SECTION 2. Section 10 -18 of the Code of Ordinances pertaining to the Board of Commissioners of Fraternal Cemetery and their term of office is hereby amended to read as follows: "Fraternal Cemetery shall be under the control of the Board of Commissioners which is hereby created con- sisting of five (5) members who shall be residents of the City of Little Rock. Each member shall be appointed for a term of three years by the City Manager subject to approval of the Board of Directors. Said Board of Commissioners shall take charge of and have control and responsibility for the operation and maintenance of said Fraternal Cemetery from and after their appoint- ment. All vacancies on the Board of Commissioners shall be filled as the original appointments are made and the person so appointed to fill the vacancy shall serve for the unexpired term of his predecessor. SECTION 3. The proposal of Oakland Cemetery to provide assistance to Fraternal Cemetery in the following particualrs is hereby approved: a) Effective as of January 1, 1974, Oakland Cemetery will pay to Fraternal Cemetery the sum of $2,500.00 annually payable in 12 equal monthly installments. b) Commencing immediately Oakland Cemetery will open all grave sites at Fraternal Cemetery at no cost to Fraternal where it is feasible to perform such services by utilizing Oakland's backhoe equipment. OGQ -SL D -)? 1 � t / -2- c) Both the cash payments and the gratuitous service herein proposed by Oakland Cemetery for the benefit of Fraternal Cemetery shall continue for so long as Oakland Cemetery receives rental from property situated in the NW corner of the inter- section of East Roosevelt Road and Confederate Boulevard and situated in NW corner of 21st and Barber. SECTION 4. The sum of $12,649.95 is hereby appropriated to be used by the City for the purpose of defraying the cost to make certain improvements to Fraternal Cemetery in keeping with the proposals set forth on Exhibit "A" attached hereto and made a part hereof. Of the total sum appropriated by this section, the sum of $7,000.00 is appropriated from the unappropriated balance of the General Fund and the sum of $5,646.95 is appropriated from the unappropriated balance of the Street Fund. SECTION 5. This Ordinance shall be in full force and effect from and after its passage. Remove existing perimeter fence along west property line and replace with 8' chain link fence: 647 L.F. @ $3.60 /L.F. $2,329.20 2. Repair existing chain link fence along the north, south and east property lines: 1,969 L.F. @ $0.50 /L.F. 984.50 3. Demolish and remove frame house and appurtenances: 500.00 4. General Landscaping: 10 days @ $650.00 /day 6,500.00 5. Grading of cemetery drives: 4,375 L.F. @ $0.20 /L.F. 875.00 6. Chip seal coat cemetery drives: 5,833 S.Y. @ $0.25 /S.Y. 1,458.25 TOTAL COST $12,646.95
