12889ORDINANCE NO. 12,889 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE STREETS AND ALLEYS IN BLOCK 1, 2, AND 3, OF THE CLINTON PARK ADDITION AND BLOCKS 3, 4, 5, 6, 7, 8, AND 9 OF MC LEAN' S ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 29th. day of October, 1973, asking the Board of Directors to vacate and abandon all of the streets and alleys in Blocks 1, 2, and 3 of the Clinton Park Addition, and Blocks 3, 4, 5, 6, 7, 8, and 9 of McLean's Addition to the City of Little Rock, as designated on the plats of said Additions now appearing of record in Plat Book 2, Page 14, and Plat Book 1, Page 203, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easements in said streets and alleys; WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the streets and alleys, hereinbefore described, have heretofore been dedicated to the public use as streets and alleys, as herein described; have not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the streets and alleys to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such streets and alleys; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: r - L, SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the streets and alleys designated as follows: 1. An unnamed alley between East Eighth Street and East Seventh Street, traversing Block 1 of the Clinton Park Addition to the City of Little Rock. 2. That part of Inez Street between East Eighth Street and East Seventh Street, intersecting Block 1 and Block 2 of the Clinton Park Addition to the City of Little Rock. 3. An unnamed alley between Inez Street and the Missouri- Pacific Railroad's spur track, traversing Block 2 of the Clinton Park Addition to the City of Little Rock. 4. An unnamed alley between Inez Street and the Arkansas Power & Light Highline Right -of -Way, traversing Block 3 of the Clinton Park Addition to the City of Little Rock. 5. An unnamed alley between East Eighth Street and another unnamed alley which separates Block 6 and Block 9 of the McLean's Addition, traversing Block 6 of the McLean's Addition to the City of Little Rock. 6. An unnamed alley between School Street and Fletcher Avenue, intersecting Block 6 and Block 9 of McLean's Addition to the City of Little Rock. 7. That part of School Street between an unnamed alley which intersects Block 5 and Block 8 of the McLean's Addition to the City of Little Rock, and the Missouri- Pacific Railroad's spur track, intersecting Block 8 and Block 9 of the McLean's Addition to the City of Little Rock. 8. An unnamed alley between East Eighth Street and East Seventh Street, intersecting Block 3 and Block 4 of the McLean's Addition to the City of Little Rock. 9. That part of Fletcher Avenue between East Eighth Street and the Missouri - Pacific Railroad's spur track, inter- secting Block 6, Block 7, and Block 9 of the McLean's Addition to the City of Little Rock. subject, however, to any public utility easements located in said streets and alleys. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3. This Ordinance shall take effect and be in force from and after its passage.
