AN ORDINANCE APPROVING AND ADOPTING AMENDMENTS
TO THE GROUP DISABILITY INSURANCE PLAN FOR NON-
UNIFORM EMPLOYEES OF THE CITY OF LITTLE ROCK;
AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. The group disability insurance plan for non-
uniform employees provided for by Ordinance #12,606 passed
January 18, 1972 by means of a contract issued by the Mutual
Benefit Life Insurance Company is hereby amended in the par-
ticulars and to the extent only as provided for and set forth
in Exhibit "A" attached hereto and made a part hereof the same
as though set out herein word for word, same being identified
as "CITY OF LITTLE ROCK, ARKANSAS DISABILITY INSURANCE PLAN
MODIFICATIONS, EFFECTIVE JULY 15 , 1975," containing Sec-
tions 1 through 6.
SECTION 2. The Mayor is hereby authorized, acting for and
on behalf of the City of Little Rock to execute the modifications
to the disability insurance plan provided for in Section 1 here-
of by his signature in the space provided at the end of said
modifications. Said modifications to the disability insurance
plan for nonuniform employees must be accepted and approved
by proper representatives of the Mutual Benefit Life Insurance
Company by their signatures in the spaces provided at the end
thereof.
SECTION 3. This Ordinance shall be in full force and effect
from and after its passage.

CITY OF LITTLE ROCK, ARKANSAS
DISABILITY INSURANCE PLAN MODIFICATIONS
EFFECTIVE JULY 15, 1975
SECTION 1 - GENERAL
The modifications herein provided to the City of Little Rock nonuniform
employees disability insurance plan are applicable to that certain contract of
insurance between the City of Little Rock, Arkansas and Mutual Benefit Life
Insurance Company of New Jersey authorized by Ordinance No. 12,606 of the Board
of Directors of the City of Little Rock passed January 18, 1972. The said modifica-
tions herein provided for have been authorized by Ordinance No. 13,070 of the Board
of Directors of the City of Little Rock, Arkansas passed July 15, 1975.
SECTION 2 - SERVICE REQUIREMENT FOR ELIGIBILITY
No employee shall become eligible for full disability insurance benefits here-
under except those with a minimum of six months service in the employ of the City
of Little Rock, Arkansas.
SECTION 3 - LONG TERM DISABILITY REQUIREMENTS
Disability benefits will not be paid in any case under this plan for long term
disability extending beyond twenty -four months, unless and until the disabled employee
shall have been declared totally disabled by the Social Security Administration.
Provided, however, these provisions requiring a determination of disability by the
Social Security Administration shall not be applicable where the reason for denying
disability by the Social Security Administration is based on something other than
actual physical or mental disability.
SECTION 4 - PHYSICAL EXAMINATION REQUIREMENTS
Upon application for benefits and during the first twenty -four months of
eligible disability an employee applicant shall be required to submit to physical
examinations by a physician retained by the City of Little Rock. In the event of
conflicting opinions as to total disability between the employee's physician and
the physician retained by the City, another physician acceptable to the employee
and the City will be retained by the City for the purpose of disability determination.
It is the intent of this provision that the concurring opinions of two physicians,
one of which has been retained by the City, will be required in determining dis-
ability before a benefit award can be made by the insurance company.
SECTION 5 - PRE - EXISTING CONDITION EXCLUSION
In no case shall an employee participant be entitled to a benefit under this
contract resulting from a physical condition, or arising from the progression of a
physical condition for which treatment has been recommended or administered by a

licensed physician within one hundred and eighty (180) days of the individual
becoming a member of the eligible group. Provided, however, that this provision
shall be waived should the participant, while a member of the eligible group,
neither receive treatment, or if treatment recommended related to a condition
otherwise constituting an exclusion for a continuous period of one year.
SECTION 6 - MISCELLANEOUS
No employees' application for disability benefits hereunder shall be eligible
for consideration except if he concurrently with the filing of said application
applies to the Social Security Administration for disability benefits as provided
thereunder.
