AN ORDINANCE AMENDING CHAPTER 36 OF THE CODE OF ORDINANCES
TO PROVIDE AN ADDITIONAL SECTION THEREIN TO BE IDENTIFIED
AS SECTION 36 -35 PERTAINING TO WRITTEN NOTICE REQUIREMENTS
TO CERTAIN PROPERTY OWNERS WHEN THE MATTER OF VACATING A
PORTION OF A PLATTED AND DEDICATED STREET OR ALLEY IS UNDER
CONSIDERATION BY THE BOARD OF DIRECTORS; AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. Chapter 36 of the Code of Ordinances is hereby amended by
adding a new section to be identified as Section 36 -35 providing notice
requirements in the matter of vacation of portions of platted streets or
alleys all as follows:
Section 36 -35. Notice requirements in vacating and closing portions
of streets or alleys.
"Before the Board of Directors shall consider an ordinance to
vacate, close and abandon a portion of a platted street or alley
in any given block or parcel of land, the petitioner (s) for such
closure shall first give not less than ten (10) days written notice
of the time, place and date of public hearing thereon to the record
owner(s) of all the property situated within said block or parcel
of land which abuts or abutted the street or alley as originally
platted. The said notice shall be sent by certified or registered
mail to the last known address of said record owner(s) and the
Petitioner(s) shall execute and file with the City Clerk an
Affidavit showing compliance therewith attaching as exhibits to
said Affidavit official evidence that said notices have been so
mailed to and received by said owner(s)."
SECTION 2. This Ordinance shall be in full force and effect from and
after its passage.
