ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS, VACATING AND CLOSING THE ALLEY IN BODMAN'S
SUBDIVISION OF BLOCK 8, WORTHEN'S SUBDIVISION TO THE
CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, a Petition was duly filed with the Board of Directors of
the City of Little Rock, Arkansas, on the 15th day of April, 1976,
asking the Board of Directors to vacate and abandon all of the alley
bounded by LOTS SIXTEEN.(16) and SEVENTEEN.(17) and running from Loyd
Street to North Street in BODMAN'S SUBDIVISION OF BLOCK 8, WORTHEN'S
SUBDIVISION to the City of Little Rock, as designated on the plat of
said Addition now appearing of record in Deed Book 184, Page 566, in the
office of the Recorder of Pulaski County, Arkansas, subject, however, to
any public easements in said alley; and
WHEREAS, after due notices as required by law, the Board of Directors
has, at the time and place mentioned in the notice, heard all persons
desiring to be heard on the question and has ascertained that the alley,
hereinbefore described, has heretofore been dedicated to the public use
as a alley, as herein described; has not been actually used by the
public generally for a period of at least five (5) years subsequent to
the filing of the plat; that all of the owners of the property abutting
upon the alley to be vacated have filed with the Board of Directors
their written consent to such abandonment; and that public interest and
welfare will not be adversely affected by the abandonment of such alley;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby released,
vacates and abandons all its rights, together with the rights of the
public generally, in and to the alley designated as follows:
The alley bounded by LOTS SIXTEEN (16) and
SEVENTEEN (17) and running from Loyd Street to
North Street in BODMAN'S SUBDIVISION OF BLOCK
8, WORTHEN'S SUBDIVISION of North Half (N %),
Northeast Quarter (NEk), Section Eight (8),
Township One (1) North, Range Twelve (12) West,
Pulaski County, Arkansas,
subject, however, to any public utility easements located in said alley.
SECTION 2. A copy of this Ordinance, duly certified by the City
Clerk, shall be filed in the office of the Recorder of Pulaski County
and recorded in the Deed Records of the County.
SECTION 3. This Ordinance shall take effect and be in force from
and after its passage.
