13170ORDINANCE NO. 13,170 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE ALLEY IN BLOCK 4, HILLCREST ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS WHEREAS, a Petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 4th day of May , 1976, asking the Board of Directors to vacate and abandon part of the alley in Block 4, Hillcrest Addition to the City of Little Rock, as designated on the plat of said Addition now appearing of record in Deed Book 1 , Page 20 , in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easements in said alley; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley, hereinbefore described, has heretofore been dedicated to the public use as an alley, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such alley; X11 i I 7 W49 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS; SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the alley designated as follows: An alley which lies South of Lots 1, 2, and 3, and North of Lot 14, Block 4, Hillcrest Addition to Little Rock subject, however, to any public utility easements located in said alley. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. r SECTION 3.
