13138ORDINANCE NO. 139138 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING A PORTION OF JACKSON STREET LOCATED IN THE 12TH STREET PIKE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 17th day of December , 1975, asking the Board of Directors to vacate and abandon a portion of Jackson Street, in the 12th Street Pike Addition to the City of Little Rock, as designated on the survey of W. William Graham, Jr., Registered Land Surveyor, being No. 720 as the same appears on file in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easement in said portion of Jackson Street; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and ascertained that the portion of Jackson Street, hereinbefore described, has heretofore been dedicated to the public use as a street, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: The East 10 feet of the Jackson Street right -of -way beginning at 12th Street and proceeding South 140 feet, subject, however, to any public utility easements located in said street. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County.
