13133ORDINANCE NO. 13,133 AN ORDINANCE ESTABLISHING A SCHEDULE OF RATES FOR THE LITTLE ROCK MUNICIPAL WATER WORKS AND FIXING THE EFFECTIVE DATE THEREOF Preamble The authority to operate and maintain the Little Rock Municipal Water Works is vested in the Board of Water Works Commissioners, but L the authority to establish water rates is vested in the Board of Dir- ectors of the city. By virtue of state law, rates must be establish - ,n ed which are adequate to pay the principal of and interest on water revenue bonds, to make payments into the revenue bond sinking fund, to provide an adequate depreciation fund and to provide the Water Works Commission's estimate of the cost of operating and maintaining the system. Under state law, the cost of capital improvements is to be included in operation and maintenance cost. O After lengthy technical studies, the Board of Water Works Commis- >i, sioners has requested the adoption of the rate increases reflected by this ordinance and has stated that the increases are necessary to pay rO for the foregoing items. The inflation rates of the years since the rd last rate increase in December 1969, have limited the resources avail - 0 able to the Little Rock Municipal Water Works in meeting its responsi- bilities; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARK- ANSAS: Section 1. . The following schedule of rates is hereby established for the Little Rock Municipal Water Works: RATE SCHEDULE NO. 6 of the LITTLE ROCK MUNICIPAL WATER WORKS Effective Date This schedule shall become effective for water delivered on or after February 3, 1976: Meter Measurement Except for public fire services, all water used shall be measured through meters. The size of each meter shall be determined by the Water Works commensurate with its estimate of the amount of water to be used for the premise. One cubic foot of water is equal to 7.5 gallons weighing 62.5 pounds avoirdupois. Minimum Monthly Charge The minimum monthly charge includes payment for the first 200 cubic feet of water used. Outside City Charges Per 100 C.F. $0.46 $0.69 0.40 0.60 0.30 0.45 0.16 0.16 Public Fire Service and City of Little Rock The City of Little Rock shall pay to the Water Works the sum of $23.33 per fire hydrant per year for the privilege of taking water from fire hydrants for fighting fires, training firemen, testing fire hydr- ants and flushing streets and sewers. Other water used by the City and paid for from its general funds shall not be subject to the minimum monthly charge, but shall be metered and paid for at the rate of 8.0� per 100 cubic feet. Nonresident Consumers The term "outside city" used in the foregoing rates refers to non- resident consumers who purchase water within the municipal boundaries, which water is then transported to a point outside the municipal bound- aries for use or resale. Said term also applied to any consumer receiv- ing service outside the municipal boundaries. Private Fire Service Private fire service connections for private premises shall pay the following annual fire service charges: Inside City Outside City Charges Charges Automatic sprinkler system - 1,000 heads or less, subject to a minimum charge of $40.00 $60.00 All additional heads, each at 0.04 0.06 Fire connection, minimum charge 40.00 60.00 Private fire hydrants, each 35.00 52.50 Standpipe, openings 14" diameter (or smaller), each 8.00 12.00 Standpipe, openings 12" diameter, each 12.00 18.00 Standpipe, openings 2" diameter, each 20.00 30.00 Standpipe, openings 2z "diameter, each 40.00 60.00 `IL. . - 3 - Billing and Payment Bills for service shall be rendered and paid monthly except as follows: a. The annual rates for public fire service shall be payable by the City of Little Rock in twelve monthly installments on or before the twentieth day of each month for services furnished the preceding month. b. Payments for private fire service shall be due in semi- annual installments in advance on the first day of January and July of each year. Penalty and Discontinuance of Service A penalty of 10/ shall be added to any bill not paid before the twentieth day following the billing date. If a bill is not paid with- in thirty days after the billing date, service for the affected premise may be discontinued; in such event, the Water Works may levy a recon- nection charge. Unaffected Services This schedule does not apply to raw water sales or to other special contracts which are deemed to be contracts for the sale of surplus water, terminable at will, at prices to be fixed by the Water Works Commission. Section 2. The Board of Directors finds that the foregoing schedule of rates is required to provide the funds necessary to pay the prin- cipal of and interest on water revenue bonds, to make payments into the revenue bond sinking fund, to provide an adequate depreciation fund and to provide the Water Works Commission's estimate of the cost of properly operating and maintaining the municipal water works system. Section 3. All ordinances and parts of ordinances establishing rate schedules for water or water services supplied or to be supplied by the City of Little Rock through its municipal waterworks system are repealed as of the effective date of the schedule herein established. Section 4. any portion, be declared the validity PASSED: The provisions of this ordinance are separable, and if section, provision, or phrase of this ordinance shall invalid or unconstitutional, such action shall not affect of the remainder of this ordinance.
