13210r ORDINANCE NO. 13,210 AN ORDINANCE VACATING, ABANDONING, AND CLOSING CERTAIN STREETS, ALLEYS, AND PORTIONS THEREOF, LOCATED IN C OX' S SUBDIVISION OF TAYLOR AND BODE- MAN'S SUBDIVISION TO THE CITY OF LITTLE ROCK AND L. G. COTTON'S SUBDIVISION OF TAYLOR AND BODE - MAN'S SUBDIVISION TO THE CITY OF LITTLE ROCK, IN CONFORMANCE WITH THE PROVISIONS OF THE URBAN RENEWAL PLAN FOR THE UNIVERSITY PARK URBAN RE- NEWAL PROJECT, PROJECT ARK R -51: AND FOR OTHER PURPOSES WHEREAS, under the provisions of Resolution No. 3166, duly adopted by the Board of Directors of the City of Little Rock, Arkansas, on June 6, 1964, the Urban Renewal Plan of the Housing Authority of the City of Little Rock, Arkansas, for the University Park Urban Renewal Project, Project ARK R -51, was formally approved; and WHEREAS, said Board of Directors in said Resolution found that in order to implement and facilitate the effectuation of said Urban Renewal Plan, certain official action must be taken by the Board of Directors, including the vacation and removal of streets, alleys, and other public ways, the establishment of new street patterns, changes in zoning, and the location and relocation of sewer and water mains and other public facilities, all as provided for in said Plan; and, WHEREAS, the objectives of said Plan have now been suffi- ciently attained to require official action be taken to vacate, close, and abandon the hereinafter described streets, alleys, and portions thereof, located in Cox's Subdivision of Taylor and Bodeman's Subdivision to the City of Little Rock, and L. G. Cotton's Subdivision of Taylor and Bodeman's Subdivision to the City of Little Rock, Pulaski County, Arkansas; and WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock on the 28th day of September, 1976, by Winrock Homes, Inc., and the Housing Authority of the City of Little Rock, as joint petitioners, asking said Board to vacate, close, and abandon certain streets, alleys, and portions thereof, in Cox's Subdivision of Taylor and Bodeman's Subdivision to the City of Little Rock, and L. G. Cotton's Sub- division of Taylor and Bodeman's Subdivision to the City of Little Rock; and, WHEREAS, after due notice, the Board of Directors has at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question; and WHEREAS, said streets, alleys, and portions thereof, are no longer needed for use as streets and alleys for travel by motor vehicle, pedestrian, or other traffic, and for means of access to other lands, and are accordingly no longer needed for corporate purposes; and, WHEREAS, under said Urban Renewal Plan and under the Plat and Redevelopment Plan submitted by petitioner, Winrock Homes, Inc., provision is made for other suitable, safe, adequate, and convenient means of access to and egress from the area involved; and, WHEREAS, in order to provide for the public welfare, safety, -2- comfort and convenience of the general public, the inhabitants of the City of Little Rock, Arkansas, and the users of said streets, alleys, and portions thereof, it is necessary to vacate, close, and abandon those streets, alleys, and portions thereof, hereinafter specifically described; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That it is hereby ascertained and de- clared that the use as public streets and alleys of those portions of the hereinafter described streets and alleys located in Cox's Subdivision of Taylor and Bodeman's Subdivision to the City of Little Rock, Arkansas, and L. G. Cotton's Subdivision of Taylor and Bodeman's Subdivision to the City of Little Rock, Arkansas, and within the University Park Urban Renewal Project, Project ARK R -51, are no longer necessary and needed by the general public and by adjoining landowners for access to other lands in the vicinity; that other streets and routes are presently in existence or will be constructed pursuant to said Urban Renewal Plan and Redevelop- ment Plan of the petitioner, Winrock Homes, Inc., which reasonably, safely, and adequately serve the needs of those members of the public traveling to and from areas now or previously served by the hereinafter described streets, alleys, and portions thereof; that said streets and alleys and portions thereof are no longer required for corporate purposes as public streets and alleys, and should accordingly be vacated, abandoned, and closed, and all of the right, title, and interest of the City of Little Rock, Arkansas, in the said vacated portions of said streets and alleys -3- should revert to the adjoining landowners with the exception, however, of the hereinafter described vacated portion of Mc- Kinley Street which shall revert solely to Winrock Homes, Inc., one of the petitioners herein, all subject to any public utility easement located therein. Section 2. That the City of Little Rock, Arkansas, under its powers as set forth in Ark. Stat. (1947) §19 -2304 and §19 -3029, hereby vacates, abandons, and closes the following described streets, alleys, and portions thereof, and relinquishes, grants and conveys unto the adjoining landowners, and as to the hereinafter described portion of McKinley Street it relinquishes, grants, and conveys solely unto Winrock Homes, Inc., all of the right, title, and interest of the City of Little Rock, Arkansas, of its inhabitants, and of the public generally, in said streets, alleys, and portions thereof, subject to any public utility easements located therein, to -wit: (a) All of 20th Street, 19th Street, and 18th Street running generally east and west from the west right of way of McKinley Street east to a point 125 feet from the west right of way of University Avenue; (b) All of 17th Street and 16th Street running generally east and west from the east right of way of Cleveland Street east to a point 125 feet from the west right of way of University Avenue; (c) All of 15th Street running generally east and west from the east right of way of Cleveland Street east to a point 125 feet from the west right of way of University Avenue; (d) All of 14th Street running generally east and west from the east right of way of Cleveland Street east to the west right of way of Garfield Street; -4- (e) All of McKinley Street running generally north and south from the south right of way of 20th Street north to the intersection of McKinley Street and Broadmoor Drive; (f) All of Cleveland Street running generally north and south from the south right of way of 20th Street north to the south right of way of 17th Street; (g) All of Arthur Street running generally north and south from the south right of way of 20th Street north to the north right of way of 14th Street; (h) All of Garfield Street running generally north and south from the south right of way of 20th Street north to the north right of way of 17th Street and thence north five (5) feet on either side of Gar- field to the southern boundary of Tract A4 -448, University Park Subdivision, appearing of record in Plat Book 35 at Page 35 in the Office of the Recorder of Pulaski County, Arkansas; (i) All alleys in Blocks 3 through 23, in- clusive, of Cox's Subdivision of Taylor and Bode - man's Subdivision, the alley running generally east and west between Block 1 of L. G. Cotton's Subdivision of Taylor and Bodeman's Subdivision and Block 15 of Cox's Subdivision of Taylor and Bodeman's Subdivision, and the alley running generally east and west between Block 1 of L. G. Cotton's Subdivision of Taylor and Bodeman's Subdivision and Block 31 of Taylor and Bodeman's Subdivision, all in the City of Little Rock, Pulaski County, Arkansas. Section 3. That a copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said county. Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. That the redevelopment of lands within which said streets, alleys, and portions thereof, are located, and access to adjacent lands, will be delayed if said streets, -5- alleys, and portions thereof, are not vacated and closed im- mediately. An emergency is, therefore, declared to exist and this Ordinance being necessary for the immediate preserva- tion of the public welfare shall take effect immediately upon its passage and approval.
