13214ORDINANCE NO. 13,214 AN ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING ALL OF BALLINGER ROAD IN THE CITY OF LITTLE ROCK FROM BATTLE ROAD TO LANCASTER ROAD WITH THE EXCEPTION OF THE NORTH TEN FEET THEREOF; AND FOR OTHER PURPOSES. WHEREAS, a request was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 6th day of October, 1976, asking the Board of Directors to vacate and abandon all of Ballinger Road in the City of Little Rock, from Battle Road to Lancaster Road, with the exception of the North ten (10) feet thereof, subject, however, to any public easements in said street; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street hereinbefore described has heretofore been dedicated to the public use as a street, as herein described; has not been actually used by the public generally for a period of at least five (S) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the street to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: All of Ballinger Road in the City of Little Rock, from Battle Road to Lancaster Road, with the exception of the North ten (10) feet thereof, subject, however, to any public utility easements located in said street. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
